RESTRICTIVE BUSINESS PRACTICESBox 6: Price-fix<strong>in</strong>g <strong>in</strong> Healthcare and Motor VehicleManufactur<strong>in</strong>g IndustriesThe South African <strong>Competition</strong> Commission <strong>in</strong>itiated and completed an<strong>in</strong>vestigation <strong>in</strong>to price fix<strong>in</strong>g <strong>in</strong> <strong>the</strong> healthcare <strong>in</strong>dustry, and has referredits f<strong>in</strong>d<strong>in</strong>gs to <strong>the</strong> <strong>Competition</strong> Tribunal. The Tribunal has determ<strong>in</strong>ed that<strong>the</strong> Respondents: <strong>the</strong> South African Medical Association (SAMA), <strong>the</strong>Hospital Association of South Africa (HASA) and <strong>the</strong> Board of HealthCare Funders (BHF) have all contravened Section 4(1)(b)(i) of <strong>the</strong><strong>Competition</strong> Act of 1998, by directly or <strong>in</strong>directly fix<strong>in</strong>g prices.With<strong>in</strong> SAMA, <strong>the</strong>re are practitioners that are competitors, for exampleurologists compet<strong>in</strong>g with o<strong>the</strong>r urologists or general practitioners compet<strong>in</strong>gwith o<strong>the</strong>r general practitioners. The recommendation of tariffs for suchpractitioners to use, <strong>the</strong>refore, constitutes price fix<strong>in</strong>g. In <strong>the</strong> case of HASA,<strong>the</strong> association recommends tariffs, <strong>in</strong> terms of which charges can be leviedfor certa<strong>in</strong> services provided by <strong>the</strong> private hospital groups, who are allcompetitors and members of HASA. Likewise, <strong>the</strong> BHF recommends ascale of benefits to its members. The tariffs are <strong>in</strong>tended to be guidel<strong>in</strong>esfor <strong>the</strong> purchas<strong>in</strong>g of healthcare services.It came to <strong>the</strong> Commission’s attention that <strong>the</strong> respondents recommend andpublish tariffs annually. Precedent by <strong>in</strong>ternational competition authoritiesviews this conduct as price fix<strong>in</strong>g under competition law.
