ENFORCEMENT OF THE COMPETITIONLAW AGAINST RBPsRBPs <strong>in</strong> <strong>Namibia</strong>, accord<strong>in</strong>g to <strong>the</strong><strong>Competition</strong> Act 2003, fall with<strong>in</strong><strong>the</strong> purview of <strong>the</strong> <strong>Namibia</strong>n<strong>Competition</strong> Commission. TheCommission is responsible for <strong>the</strong>adm<strong>in</strong>istration and enforcement ofthis Act and, <strong>in</strong> addition to any o<strong>the</strong>rfunctions conferred to it. 53RBPs <strong>in</strong> <strong>Namibia</strong>, accord<strong>in</strong>gto <strong>the</strong> <strong>Competition</strong> Act 2003,fall with<strong>in</strong> <strong>the</strong> purview of <strong>the</strong><strong>Namibia</strong>n <strong>Competition</strong>Commission.Pursuant to Section 33 (1) <strong>the</strong> Commission may, ei<strong>the</strong>r on its own <strong>in</strong>itiative orupon receipt of <strong>in</strong>formation or a compla<strong>in</strong>t from any person, start an<strong>in</strong>vestigation <strong>in</strong>to any conduct or proposed conduct which is alleged toconstitute or may constitute an <strong>in</strong>fr<strong>in</strong>gement of:• <strong>the</strong> Part I prohibition (Restrictive Agreements, Practices and Decision);or• <strong>the</strong> Part II prohibition (Abuse of Dom<strong>in</strong>ant Position).Any organisation or <strong>in</strong>dividual believ<strong>in</strong>g <strong>the</strong>ir rights and <strong>in</strong>terests have been<strong>in</strong>fr<strong>in</strong>ged by a violation of <strong>the</strong> Act (for <strong>in</strong>stance, a company that th<strong>in</strong>ks <strong>the</strong>practices of a competitor are <strong>in</strong> breach of <strong>the</strong> Act) has <strong>the</strong> right to lodge acompla<strong>in</strong>t with <strong>the</strong> Commission. Section 57 of <strong>the</strong> Act imposes <strong>the</strong> time limitfor commencement of <strong>in</strong>vestigation. An <strong>in</strong>vestigation <strong>in</strong>to an alleged<strong>in</strong>fr<strong>in</strong>gement of <strong>the</strong> Part I or <strong>the</strong> Part II prohibition may not be <strong>in</strong>itiated afterthree years from <strong>the</strong> date <strong>the</strong> <strong>in</strong>fr<strong>in</strong>gement has ceased.If <strong>the</strong> Commission, hav<strong>in</strong>g received from any person a compla<strong>in</strong>t or a requestto <strong>in</strong>vestigate an alleged <strong>in</strong>fr<strong>in</strong>gement decides not to conduct an <strong>in</strong>vestigation,<strong>the</strong> Commission must <strong>in</strong> writ<strong>in</strong>g <strong>in</strong>form that person of <strong>the</strong> reasons for itsdecision. The Act does not give <strong>the</strong> right to appeal aga<strong>in</strong>st such decision.On <strong>the</strong> o<strong>the</strong>r hand, if <strong>the</strong> Commission decides to conduct an <strong>in</strong>vestigation, itmust <strong>in</strong> writ<strong>in</strong>g give notice of <strong>the</strong> proposed <strong>in</strong>vestigation to every undertak<strong>in</strong>g<strong>the</strong> conduct of which is to be <strong>in</strong>vestigated and must <strong>in</strong> <strong>the</strong> notice:• <strong>in</strong>dicate <strong>the</strong> subject-matter and purpose of <strong>the</strong> <strong>in</strong>vestigation; and• <strong>in</strong>vite <strong>the</strong> undertak<strong>in</strong>g concerned to submit to <strong>the</strong> Commission, with<strong>in</strong> aperiod specified <strong>in</strong> <strong>the</strong> notice, any representations which <strong>the</strong> undertak<strong>in</strong>gmay wish to make to <strong>the</strong> Commission <strong>in</strong> connection with any matter to be<strong>in</strong>vestigated.54 <strong>Enforc<strong>in</strong>g</strong> <strong>the</strong> <strong>Competition</strong> <strong>Law</strong> <strong>in</strong> <strong>Namibia</strong>: A <strong>Toolkit</strong>
