COMPETITION VS INTELLECTUALPROPERTY LAWIPRs protection is a policy tool meant to foster<strong>in</strong>g <strong>in</strong>novation; which benefitsconsumers through <strong>the</strong> development of new and improved goods and services,and spurs susta<strong>in</strong><strong>in</strong>g economic growth. It bestows on <strong>in</strong>novators <strong>the</strong> right tolegitimately exclude, for a limited amount of time, o<strong>the</strong>r parties from <strong>the</strong>benefits aris<strong>in</strong>g from new knowledge, and more specifically, from <strong>the</strong>commercial use of <strong>in</strong>novative products and processes based on that newknowledge. In o<strong>the</strong>r words, <strong>in</strong>novators or IPR holders are rewarded with atemporary monopoly by <strong>the</strong> law to recoup <strong>the</strong> costs <strong>in</strong>curred <strong>in</strong> <strong>the</strong> researchand <strong>in</strong>novation process and earn rightful and reasonable profits, so that <strong>the</strong>yhave <strong>in</strong>centives to <strong>in</strong>vest <strong>in</strong> fur<strong>the</strong>r research and <strong>in</strong>novation.<strong>Competition</strong> law, on <strong>the</strong> o<strong>the</strong>r hand, has always been regarded by most asessential <strong>in</strong> curb<strong>in</strong>g market distortions, discipl<strong>in</strong><strong>in</strong>g anticompetitive practices,prevent<strong>in</strong>g monopoly and abuse of monopoly, <strong>in</strong>duc<strong>in</strong>g optimum allocationof resources and benefit<strong>in</strong>g consumers with fair prices, wider choice and betterqualities. It, <strong>the</strong>refore, ensures that <strong>the</strong> monopolistic power associated withIPRs is not excessively compounded or leveraged and extended to <strong>the</strong> detrimentof competition. Fur<strong>the</strong>r, while seek<strong>in</strong>g to protect competition and <strong>the</strong>competitive process, which <strong>in</strong> turn prod <strong>in</strong>novators to be <strong>the</strong> first <strong>in</strong> <strong>the</strong> marketwith a new product or service at a price and quality that consumers want,competition law underscores <strong>the</strong> importance of stimulat<strong>in</strong>g <strong>in</strong>novation ascompetitive <strong>in</strong>puts, and thus also works to enhance consumer welfare.Thus, it is now generally recognisedthat <strong>the</strong> goals of competition law andIP law are ra<strong>the</strong>r complementary andmutually re<strong>in</strong>forc<strong>in</strong>g. They share <strong>the</strong>common purpose of promot<strong>in</strong>g<strong>in</strong>novation, enhanc<strong>in</strong>g andbenefit<strong>in</strong>g customer welfare as wellas allocat<strong>in</strong>g efficient economicresources. Moreover, <strong>the</strong>y are alsodifferent levels of market regulation.Errors or systematic biases <strong>in</strong> <strong>the</strong><strong>in</strong>terpretation or application of oneIn view of current status of<strong>the</strong> <strong>Namibia</strong>n <strong>Competition</strong>Act, which is not deal<strong>in</strong>gwith <strong>the</strong> <strong>in</strong>tellectual propertyrights <strong>in</strong> explicit manner, <strong>the</strong>considerations de lege latacould serve as a start<strong>in</strong>gpo<strong>in</strong>t for futureimprovements of <strong>the</strong> Act <strong>in</strong>this regard.policy’s rules can harm <strong>the</strong> o<strong>the</strong>r policy’s effectiveness.
