Boe<strong>in</strong>g conv<strong>in</strong>ced <strong>the</strong> EC to declare <strong>the</strong> merger compatible with <strong>the</strong>common market after mak<strong>in</strong>g concessions that were not demanded by <strong>the</strong>FTC:• Boe<strong>in</strong>g committed to keep <strong>the</strong> Douglas Aircraft Company, <strong>the</strong> civilaircraft division of McDonnell Douglas, a separate company for 10years, until 2007, and to supply <strong>the</strong> EC with reports on <strong>the</strong> company’sperformance.• Boe<strong>in</strong>g committed not to l<strong>in</strong>k <strong>the</strong> sale of Boe<strong>in</strong>g aircraft to its access to<strong>the</strong> Douglas fleet <strong>in</strong> service.• Boe<strong>in</strong>g canceled its exclusive supplier contracts with American, Delta,and Cont<strong>in</strong>ental and promised to refra<strong>in</strong> from enter<strong>in</strong>g <strong>in</strong>to such dealsuntil 2007.• Boe<strong>in</strong>g offered its competitors nonexclusive licenses for patents aris<strong>in</strong>gfrom publicly f<strong>in</strong>anced research and development.• Boe<strong>in</strong>g gave assurances that it would not use its relationships withsuppliers to obta<strong>in</strong> preferential treatment.• Boe<strong>in</strong>g agreed to provide <strong>the</strong> EC with annual reports for 10 years onits non-classified aeronautical projects that receive public fund<strong>in</strong>g.
