Memorandum #11-167Attachment IV-3To: Doug Russell, City ManagerFrom: Bradley Moser, Civil EngineerSubject: Final Project Acceptance and Final Paymentfor the Gehl Drive Extension ProjectDate: October 3, 20]]In conjunction with the East Yankton Industrial Park development and the expansion of DakotaTrailer, the completion of the Gehi Drive Extension project has been accomplished. The projectengineer, Eisenbraun and Associates, has submitted the attached documentation for review and asksthat the project be accepted by the City. The funding mechanism for the project included aCommunity Development Block Grant (CDBG) that the City Commission authorized by Resolution#10-29.The project had a net construction cost increase of $7,972.58, which changed the project cost from$329,429.33 to $337,401.91. The main increase, of $9,619.62, was the work associated withconstruction change order (CCO) #4. This work change directive provided for the chain link fence,adjacent to the west side of the right-of-way, to be removed and reinstalled to match the newtopography. The remaining balance is due to the quantity adjustments for each bid item to thoseactually constructed.In addition to the adjusted construction cost, there were also liquidated damages that were applied.Both dates, substantial completion and final completion, were not met by the contractor. As per thecontract, the contractor was assessed damages for 29 days, for a total of $8,700.00. This amountwas deducted from the $73,105.33, originally owed the contractor, leaving a final payment amountof $64,405.33.City staff has inspected the project and reviewed the final pay request.
