Separability: The invalidity <strong>of</strong> one or more provisions or clauses <strong>of</strong> this section shall notinvalidate or impair the section as a whole or any other part here<strong>of</strong>.Section 42 - Floodplain District Use and Development42-1. Purpose-The purpose <strong>of</strong> this floodplain district is to protect the public health, safety and generalwelfare, to protect human life and property from the hazards <strong>of</strong> periodic flooding, to preserve the naturalflood control characteristics, and the flood storage capacity <strong>of</strong> the floodplains.42-2. All development in the district including structural and non-structural activities, whetherpermitted as a matter <strong>of</strong> right, by special permit or by variance shall be in compliance with thefollowing:780 CMR, Massachusetts State Building Code, Section 3107-Flood Resistant Construction42-3. Definitions for this Section only:A-Zones: Flood-hazard zones - all areas which have been determined to be prone to flooding, but notsubject to high-velocity waters or wave action.Base Flood Elevation: The flood having a 1% chance <strong>of</strong> being equaled or exceeded in any given yearand shall be used to define areas prone to flooding, and describe at a minimum, the depth or peakelevation <strong>of</strong> flooding.Basement/cellar: Any area <strong>of</strong> the building having its floor sub-grade (Below ground level) on all sides.Breakaway Wall: A wall that is not part <strong>of</strong> the structural support <strong>of</strong> the building and intended throughits design and construction, to collapse under specific lateral loading forces, without causing damage tothe elevated portion <strong>of</strong> the building or supporting foundation system.Elevation: The placement <strong>of</strong> a structure above flood level to minimize or prevent flood damagesFlood Hazard Zones: Areas which have been determined to be prone to flooding but not to highvelocity waters or wave action. (A ZONES)Floodpro<strong>of</strong>ing: Any combination <strong>of</strong> structural and non-structural additions, changes or adjustments tostructures which reduce or eliminate flood damage to new or substantially improved non-residentialstructures.F.E.M.A.: Federal Emergency Management Agency.Flood Insurance Rate Map: Flood insurance rate map (FIRM) means an <strong>of</strong>ficial map <strong>of</strong> a community,which delineates both the special hazard areas and the risk premium zones applicable to the community.High-hazard Zones (V Zones): Areas <strong>of</strong> tidal influence which have been determined to be subject towave run heights in excess <strong>of</strong> three feet or subject to high-velocity wave run-up or wave-inducederosion (VZones).Highest Adjacent Grade: The highest natural elevation <strong>of</strong> the ground surface, prior to construction,adjoining the proposed foundation walls <strong>of</strong> a structure.Impact Loads: Loads induced by the collision <strong>of</strong> solid objects on a structure carried by floodwater.Lowest Floor: The lowest floor <strong>of</strong> the lowest enclosed area (including basement/cellar). An unfinishedor flood resistant enclosure, usable solely for parking <strong>of</strong> vehicles, building access, or incidental storagein an area other than a basement/cellar with appropriate hydrostatic openings as required in 780 CMR3107.5.3 is not considered a building's lowest floor.Manufactured Home: See DEFINITIONS, 780 CMR 3502.Scouring: The erosion or washing away <strong>of</strong> slopes or soil by velocity waters.
