The minimum quantity to be quoted is 1920 MT (approx.) for Gr-II LM, 449MT (approx.) for Gr-II LM (High Sulphur), for 129 MT Gr-III LM, for 62 MT Spl.LM& for 130 MT Alloy Pig Iron. The bids for part quantity for above items shall notbe accepted. The bidder may quote for all the items or individual item.(2)5. The bidders are advised to inspect the material they are quoting for beforesubmission of bids. M/s. IKIWL shall not entertain any objection to the quality orquantity of pig iron after it has been loaded to trucks and invoice has been issued.

( 3 )6. The pig iron shall be loaded and dispatched from the Stockyard of M/s.IDCOL Kalinga Iron Works Limited (IKIWL) situated at 19, PTR Siding, Sibpur Char,Howrah.7. Bids received otherwise than in response to such advertisements shall not beentertained.8. Bidders shall quote their prices per Metric Ton (MT) Ex-Kolkata Stockyard. Allthe other charges like, W.B. VAT and other levies & duties payable under the Law, ifany, shall be charged extra on the date of billing. This date shall be treated as thedate of transaction in question.9. The Tender document, duly signed in each page as a token of acceptance ofthe terms & conditions, shall be submitted in a sealed cover superscribing theTender Call Notice No., Name of the tenderer and due date of submission on the topof the envelope. In any case, it will be presumed that the bidders have agreed tothese terms & conditions.The bids may be submitted by post or courier or personally as consideredconvenient by the bidders. However, M/s. IDCOL shall not be responsible for anypostal delay and other delays in receipt of the bids.10. If the sales tax and other levies & duties payable under the Law areincreased with retrospective effect, the additional burden shall be borne entirely bythe purchaser / successful bidder.11. The prices quoted in the bid other than in the manner prescribed above shallnot be valid and the bid shall be rejected. No replacement bid shall be acceptable.

( 4 )12. The bidders must mention in their bids the purchase price per MT in figuresas well as in words without erasing, cuttings and over-writings. The prices quotedshould be legible and have no ambiguity. Otherwise the bid shall be rejected. Incase of variation between the prices quoted in words and figures, those quoted inwords shall be final.13. The bidders must give their full Name, address, Excise control code number,Sales Tax Registration number, PAN and Telephone numbers in the bids submittedby them. They should also give their FAX number and e-mail address, if they haveone. They shall be intimated at either of these addresses about the acceptance oftheir bid. Notwithstanding the intimation as above, they shall keep in touch with theKolkata Office about the fate of their bids. Non receipt of intimation above in timeshall not be permitted to be the reason for non payment within the stipulated time.No intimation shall be given, where the bids are rejected.14. The Earnest Money Deposit (EMD) shall be submitted alongwith the bid in theform of crossed Demand Draft/ Bankers Cheque/ Pay Order drawn in favour of “M/s. IDCOL Kalinga Iron Works Ltd. ” and payable at Kolkata as below.EMDAMOUNTa) For LM-II the deposit shall be Rs.7.00 Lakh.b) For LM-II (High Sulphur) deposit shall be Rs.2.50 Lakh.c) For LM-III deposit shall be Rs.1.00 Lakh.d) For Spl. LM deposit shall be Rs.1.00 Lakhe) For Alloy Pig Iron deposit shall be Rs.1.00 LakhNo interest will be paid on the EMD amount. The EMD of unsuccessful bidder shallbe refunded as early as possible.The EMD of successful bidder shall be converted into security deposit(interest free) and shall remain at the entire disposal of IDCOL as security forsatisfactory execution and completion of the transaction in question. In the event offailure to deposit the sale value as stipulated in Clause-16 or failure to execute thetransaction satisfactorily, the security deposit thereof shall be forfeited and the dealshall be closed.

( 5 )The EMD / any amount of any previous transactions can not be adjusted inthis deal.15. All the bids received shall be opened at Kolkata Liaison Office, Kolkata afterthe time limit fixed for receipt of bids is over.16. Payment shall be made in advance prior to lifting of material. It shall be paidat Kolkata Office by the successful bidder in the form of Crossed Demand Draft /Pay Order / Bankers Cheque/ Cheque drawn in favour of “ M/s. IDCOL Kalinga IronWorks Ltd. ” and payable at Kolkata within 6 (Six) working days of intimation tothem of the acceptance of their bid to book the material. This intimation shall begiven over telephone or FAX or otherwise.The entire allotted quantity of material shall be lifted by the successful bidderor their authorized nominees within 15 working days from the date of intimation.17. The weighment recorded at the weighbridge nominated by IKIWL (KolkataLiasion Office) shall be final & binding on buyer & seller for all purposes.18. No interest will be payable on EMD / Security Deposit and on the advancepayment.19. In case of default on the part of successful bidders, in making payment andexecuting the transaction satisfactorily as above, M/s. IDCOL and M/s. IKIWLreserve the right to forfeit the EMD/ Security Deposit and shall also be free from allthe contractual obligations of the sale. M/s. IKIWL / IDCOL shall have the right to sellthe pig iron in any manner considered desirable by them. In such case, the financialloss if any, to the Corporation shall be recovered from the advance payment madeby the successful bidder or any amount payable to such purchaser.20. It shall be the responsibility of purchasers to make arrangements forreceiving, transporting and unloading the pig iron at the destination. However, properliaison shall be maintained with Kolkata Office of IKIWL for smooth despatch ofmaterial.

( 6 )21. M/s. IKIWL shall not bear any transit risk.22. Arbitration : That in case of disputes between the parties, the matter shall bereferred to the arbitration of Chairman-cum-Managing Director of the IndustrialDevelopment Corporation of Orissa Limited, IDCOL House, Ashok Nagar,Bhubaneswar or to an arbitrator nominated by the Chairman-cum-Managing Directorof the I.D.C. of Orissa Limited in case the said Chairman-cum-Managing Director forany reason is not in a position to arbitrate. The award of the arbitrator shall be final,binding and conclusive.That, in all cases the arbitration proceedings shall be conducted atBhubaneswar or in the Factory Site at Barbil and at no other place.That, all legal proceedings in any manner arising out of or in relation to thecontract between the parties can only be initiated in a court of law situated within theterritorial jurisdiction of the State of Orissa and none of the parties shall have theliberty of initiating any legal proceedings any where beyond the territorial limits of theState of Orissa.23. Force Majeure : This is subject to force Majeure clauses and the performanceof the contract either wholly or in part will be governed by the standard force majeureclauses. Any failure of the contract due to strike, cyclones etc. and all other causesbeyond the control of the Company, IDCOL / IKIWL shall not be responsible for thesame in any manner whatsoever.24. Management reserves the right to accept / reject / cancel / defer any or allthe bids at any stage without assigning any reasons.
