Steinerנוהגים העמים ‏(צ"ל בעמים)‏ אשר סביבותינו לומר ביום הכפוריםכל נדרי ואומר ‏(צ"ל ואומר')‏ דברי הערמה לשנה הבאה.‏11In the nations around us, there is a practice of saying KolNidre on Yom Kippur, reciting a verbal evasion for thecoming year.This reference is explained more fully in another source:רבינו האי השיב על אותם האומרים דהתרת נדרים ושבועותשיעמוד אדם בראש השנה ויאמר כל נדר שאני עתיד לידור כל השנההרי הוא בטל ובלבד שיהא זכור בשעת הנדר וכו'.‏ אמר ח"ו שאיןלנו להתנהג בכך ולא בענין המשנה ההיא שמביאין לראיה....‏ ח"ו כילא אל חפץ רשע הוא ולא יגור עמו רע.‏ אלו היו יודעים בני אדם ענין12נדר וענין שבועה לא היו מערימים כלל וכל המערים כאלו....‏Rabbenu Hai answered those who say that the release ofvows and oaths is (prescribed in the emended mishnah thatstates) that a person “should stand at the beginning of theyear and say ‘every vow that I may make during the wholeyear is hereby void,’ (and it shall be so)—provided that heremembers this at the time of the vow, etc.” He said“Heaven forbid, for we should not behave in this way, not(even) according to the mishnah that they adduce asproof.... Heaven forbid, for He is not a God who desireswickedness, nor can evil abide with Him (cf. Ps 5:5). Ifpeople only knew the meaning of vows and the meaning ofoaths, they would not practice evasion at all. And everyonewho practices evasion is as if....An earlier but less conspicuous rejection of the talmudic practice isfound in a responsum of R.
