GC.15.6GC.15.7GC.15.8GC.16GC.16.1GC.16.2(a)(b)(c)Unless otherwise required, all references to a particular paragraph,sup-paragraph, appendix or schedule shall be a reference to thatparagraph, sub-paragraph, appendix or schedule in or to that part ofthe SWDC in which the reference is made.A cross-reference to another document or part of the SWDC shall notimpose any additional, further or co-existent obligation or confer anyadditional, further or co-existent right in the part of the text wheresuch cross-reference is contained.Unless otherwise provided for, all references to laws, legislation,implementing regulations, directives and to standards shall be deemedto be to the then latest version.Statutory and Licence obligationsNothing in the SWDC is intended to or shall derogate from the DWTSO’s ora User’s statutory or licence obligations.The term ‘DWTS’ includes every part of the DWTS, whether or not suchpart is connected to another part of the DWTS.The term ‘DWTSO’ refers to the Person carrying on the functions of DWTSoperation, whether carried out through a single entity or through a numberoffices and/or locations. The DWTSO shall be responsible for setting up andmanaging its internal organization to ensure compliance with its obligationsunder the SWDC.TRANSITIONAL PROVISIONSNotwithstanding the provisions of any other part of these GeneralConditions, the following provisions shall apply in their place in respect of:(a)(b)(c)(d)the first establishment of the Review Panel;the appointment of Review Panel Members in respect of a class ofUser which does not have any persons within it at the time of theappointment;derogations to be granted in relation to the DWTS and/or plant andequipment connected to the DWTS at the time of the first approval ofthe SWDC; andthe treatment of and population of data in the first year of operation ofthe SWDC.Review Panel EstablishmentThe first Review Panel Members will be appointed by ECRA. ECRA will,at its sole discretion, decide on the first Review Panel Members. It may doso without discussing possible members with the DWTSO and/or Users or itmay discuss possible members with any or all of the DWTSO and each User.The DWTSO and each User must, if asked by ECRA, make suggestions asto the identity of possible members for the Review Panel, and respond to anyother question raised by ECRA. Upon deciding who the first Review PanelMembers will be, ECRA will notify the DWTSO and each User affected bythe appointments.7561A01/FICHT-7235220-v22GC-8
