Case 2: IPPC Installation; Waste Act
Environmental Record of the company:
� The operator had three infringement procedures in the
course of the last 5 years, not complying with permit
conditions
� The workplace inspectorate charged the company two
times for exceeding workplace immission values
� Waste management concept, requested by the
permitting authority, was not submitted in time
Case 2: IPPC Installation; Waste Act
Proposal for the Misdemeanor and Criminal Court:
� Due to the repeated infringement by the operator
and the high potential of environmental damage, not
only a misdemeanor charge was prepared, but also a
statement to the Public Prosecutor
� The misdemeanour court sentenced the company to a
40.000 € fine and the cost of the re-import and adequate
disposal of the solvents (60.000 €)
Case 3: IPPC site and Water Act
Case 3/ Legal Provisions:
� An operator has to apply for a permit with the
competent authority, when significant emissions to the
surface- or groundwater are expected for the activity at
the installation.
� Infringements can be fined up to 36.000 € by the
misdemeanour authority in cases where a significant
contamination of the water body occurs
