Remediation in case of damage occurred:
� Operator has to take containment/ mitigation
measures
� Operator has to develop and propose remediation
plans to competent authority for approval
� Operator has to take remediation measures

� Discretionary subsidiary action by the CA
Three Remediation types:

Type of Remediation
� Primary remediation: returns damaged natural
resources/impaired services to baseline condition
� Complementary remediation: provides a
similar level of damaged natural resources or
impaired services in case restoration is
impossible, including at an alternative site
� Compensatory remediation: compensates for
the interim loss of damaged natural resources or
impaired services between damage and full
remediation
