How Will Budget <strong>2016</strong> Affect<br />

SME and the Franchise Industry?<br />

The recent Malaysian Budget <strong>2016</strong> on 23rd October 2015<br />

with the theme “Prospering the Rakyat” is the first budget<br />

under the 11th Malaysian Plan and was announced by our<br />

Prime Minister, Datuk Seri Najib Razak. It sees the increase<br />

of RM3.2 million in our estimated revenue of RM225.7 million<br />

in Budget <strong>2016</strong> compared to last year. As for the expenditure,<br />

the budget allocates a total of RM267.2 billion compared with<br />

the revised RM260.7 billion in 2015. Of this amount, RM215.2<br />

billion is for Operating Expenditure and RM52 billion for<br />

Development Expenditure.<br />

For all intents and purposes, it is a budget where the economic<br />

sector is focusing carefully hoping that there will be some<br />

relief for them especially the SMEs and most importantly, how<br />

to expand their business in this challenging wide arena. The<br />

economic sector receive the highest share of RM30.1 billion<br />

from the Development Expenditure of RM52 billion and the<br />

Budget is said to premise on striking a balance between the<br />

Capital Economy and People Economy.<br />

It is well understood based on the current slow moving economy<br />

due to the low spending of consumer in the past few months up<br />

to now coupled with the current weakened ringgit together with<br />

the recent implementation of Goods and Services Tax (GST) on<br />

this April 2015, the Budget is hoping to strengthen back the<br />

economy and encouraging the SMEs to grow intensively. The<br />

budget acknowledges that the SMEs indeed plays an important<br />

role in developing business and the Government is expecting the<br />

GDP growth rate from the SMEs to be at 41% by 2020. Therefore,<br />

five initiatives have been introduced and will be undertaken:<br />

Provide an additional RM1 billion for the Shariah-compliant SME Financing Scheme until 31<br />

December 2017 with the Government subsidising 2% of the financing profit rate;<br />

Allocate RM107 million for the SME<br />

Blueprint to provide funds for entities<br />

at various stages of business<br />

development;<br />

Allocate RM60 million for the Entrepreneurs Acceleration Scheme, and SME Capacity and<br />

Capability Enhancement Scheme;<br />

Establish a RM200 million SME Technology Transformation Fund under the SME Bank to<br />

provide soft loans at 4%; and<br />

RM18 million to expand the Small Retailer Transformation Programme (TUKAR) and<br />

Automotive Workshop Modernisation (ATOM) projects.<br />

Apart from the five initiatives, there are a few points worth to<br />

take note from the Budget <strong>2016</strong>. It seems that the budget<br />

focuses a lot on improving the infrastructure and transportation<br />

especially in the capital of Kuala Lumpur, Selangor and Klang<br />

area. Reducing traffic congestion, improving transportation<br />

facilities, possibility of constructing a coastal highway, and<br />

upgrading of airports can be seen as one of the key point to<br />

ease the current heavily congested capital city and to ensure the<br />

economy to grow rapidly by encouraging SMEs and well-known<br />

brand chain franchise to setup more businesses in the<br />

capital city.<br />

To benefit further of the current ringgit currency and in efforts<br />

to attract more tourists, 100% income tax exemption on<br />

statutory income for tour operators will be extended from year<br />

of assessment <strong>2016</strong> until 2018. These are certainly good news<br />

to the tour operators and hopefully by <strong>2016</strong> the retailers will<br />

recover from the recent declination of purchasing power of<br />

Malaysian’s consumers due to the recent toll hikes and a few<br />

price increased.<br />

SMEs and the local franchise industry must try to keep their cost<br />

checked to avoid any possible price increase unless necessary,<br />

to keep the consumer from leaving. Selling of local Malaysian<br />

products are encouraged to avoid any increased of cost due to<br />

importation of goods and services as these will attract higher<br />

GST due to the current weakened Ringgit. Proper planning of<br />

cost management and cash flow management are extremely<br />

important to maintain the businesses.<br />

Retailers are seen to be the main focus here to ensure<br />

more tourist are attracted to Malaysia as the Government is<br />

targeting 30.5 million tourists which expected to contribute<br />

RM103 billion to the economy. Franchisee should take this<br />

opportunity to expand their brand to strengthen their platform<br />

by influencing the buying power of the tourists before tackling<br />

overseas franchise. To facilitate the tourists visiting Malaysia, the<br />

Government will implement E-Visa by mid-<strong>2016</strong>.<br />

With GST implemented, SMEs and the local franchise industry<br />

have been advised to expand by exploring into the possibilities<br />

of exporting their products or services into international market.<br />

As exporting will be charged 0% in terms of GST and the current<br />

level of Malaysian currency, it is good news that a sum of RM235<br />

million will be allocated to MATRADE for 1Malaysia Promotion<br />

Programme; Services Export Fund and Export Promotion Fund.<br />

The SMEs are encourage to tackle the China market and the<br />

Bank Negara will be providing the Ringgit-Renminbi credit swap<br />

facility for local banks in order to diversify the use of foreign<br />

currency in trade transactions.<br />

In another separate matter, local SMEs have to take this<br />

revised provision of penalty seriously in order to avoid possible<br />

penalisation by the authorities. With the current revision of<br />

penalty of non-filing of tax return Form C, there is an extension<br />

from Budget 2015 which was RM200 – RM20,000 penalty<br />

on offender to Budget <strong>2016</strong> which is RM200 – RM20,000 for<br />

first year non submission and RM1,000 – RM20,000 for nonsubmission<br />

of more than two years. Apart from that, initially there<br />

is no penalty for disclosing wrong info in tax return Form C but<br />

with the recent proposal we will be seeing a penalty of RM200 –<br />

RM20,000 coming into operation of the Act.<br />

In this challenging times for the SMEs and the local franchise<br />

industry, Cheng & Co have been waiting to see the business<br />

owners to grow not only in Malaysia but internationally and<br />

with the recent implementation of GST this year, it forced the<br />

businesses to look for opportunities beyond the bad times and<br />

to move forward. We know in these desperate times, proper<br />

guidance and professional advice must be provided, Cheng<br />

& Co as one of the largest home grown Accounting Firm in<br />

Malaysia are able to understand the needs and the uncertainties<br />

especially GST, faced by the business owners especially SMEs<br />

and the franchise industry on how to further strengthen and<br />

expand their business.<br />

Currently, SMEs are eligible to claim income tax exemption of<br />

10% or 15% of the value of increase in exports and to further<br />

increase exports, SMEs now are given flexibility to comply with<br />

the value-add condition that is from 30% to 20% and from 50% to<br />

40% for manufactured products. The Budget is giving flexibility for<br />

years of assessment <strong>2016</strong> to 2018.<br />

With the current market flowing towards an increasingly<br />

liberalized global market, it requires Malaysian SMEs to move<br />

beyond national boundaries. We will be seeing soon enough<br />

where the Trans Pacific Partnership (TPP) will take place in the<br />

near future. SMEs and the local franchise industry should take<br />

this opportunity and prepared themselves to utilize the market<br />

access opportunity as soon as possible.<br />

• Success of Existing Franchisees; or<br />

• Overall Brand Valuation<br />

In this article, we shall use brand<br />

valuation as a proxy for successful<br />

franchises. Taking reference from<br />

millwardbrown.com and Brand Finance,<br />

the most successful global franchise<br />

brands are (in terms of brand valuation)<br />

McDonalds (USD 86.7 billion),<br />

Starbucks (USD 25.7 billion) and<br />

Subway (USD 21.0 billion).<br />

So what exactly makes these three<br />

global brands the most successful global<br />

franchise brands?<br />

McDonald’s<br />

From an external point of view, many<br />

observers and analysts attribute the<br />

success of McDonald’s to the following<br />

reasons:<br />

• Great Operating Model (Consistency)<br />

- McDonald’s has one of the most sound<br />

and operationally solid business platforms<br />

in the world regardless of industry.<br />

• Collaborative Relationships with<br />

Franchisees (Innovation) - McDonald’s<br />

has one of the most synergistic working<br />

relationships with their franchisees in the<br />

franchise industry. The Breakfast Menu,<br />

Fillet-O-Fish, Big Mac, Apple Pie, Egg<br />

McMuffin, McFlurry have all come from<br />

franchisee’ suggestions.<br />

• Brand Development (Audience<br />

Knowledge & Exposure) - McDonald’s<br />

spends over one billion dollars per<br />

year on brand development and<br />

advertising. This brand development is<br />

what has fueled the growth of not only<br />

the franchise system, but each of the<br />

operating units themselves.<br />

• Financial Management -<br />

McDonald’s owes the real estate<br />

that the franchisee’s operate on, the<br />

McDonald’s system became one of the<br />

largest land owners in the world in a<br />

very short time period.<br />

• Vendor Relationships - Coca-Cola is<br />

the most prominent of the vendors, but<br />

each of the supplier’s partners play a<br />

critical role in the successful expansion<br />

of the franchise.<br />

However, from an internal point of<br />

view, McDonald’s success hinge on the<br />

following critical factors:<br />

• Focusing on Offering the Best Value<br />

(Product) - McDonald’s spent several<br />

years experimenting with high-end<br />

items like Angus beef burgers and<br />

Chicken Selects. By focusing on this,<br />

McDonald’s ignored one of its biggest<br />

strengths. CEO Don Thompson is<br />

luring back cash-strapped customers<br />

with low-priced offerings like the<br />

Jalapeno McDouble and Buffalo Ranch<br />

McChicken in USA.<br />

• Focusing on Customer Service<br />

(Service) - McDonald’s drive-thru<br />

wait times have gotten worse over<br />

the years, in-part because of an<br />

increasingly complex menu. The CEO<br />

acknowledged this problem and said<br />

that the company is sending corporate<br />

representatives in for a “service<br />

reset,” which include adding more<br />

workers and assigning new tasks<br />

to existing ones. Company is also<br />

remodelling European kitchens for<br />

faster food assembly.<br />

• Focusing on Simplicity - McDonald’s<br />

menu has grown 70% since 2007.<br />

The new menu items are a burden on<br />

employees, and have helped contribute<br />

to long wait times. Franchisees are<br />

also angry about the overloaded<br />

menu, saying that the extra ingredients<br />

and equipment are costing them<br />

money. Company is streamlining<br />

their merchandising menu board<br />

and product offerings and in addition<br />

to making it easier for customer to<br />

order their favourite products, aimed<br />

at reducing complexity which in turn<br />

should enhance accuracy and speed<br />

of service.<br />

• Focusing on Marketing (Outreach) -<br />

many view McDonald’s as unhealthy<br />

junk food. In order to improve<br />

public perception of the company,<br />

McDonald’s is doing a global audit of<br />

the marketing department. In January<br />

2015, Company will move from a<br />

philosophy of “billions served” -- a line<br />

featured on the chains’ marquees<br />

-- to “billions heard.” On various social<br />

media platforms, McDonald’s will<br />

continue to actively listen to customer<br />

feedback and keep the lines of<br />

communication open.<br />

Starbucks<br />

From an external point of view, many<br />

observers and analysts attribute the<br />

success of Starbucks to the following<br />

reasons:<br />

• Right Market Segmentation -<br />

These reasons can be seen in the market<br />

entry and engagement of Starbucks in<br />

China. As is the case with the Japanese,<br />

Chinese people live as extended families<br />

in small houses. This means that there is<br />

a strong demand for Starbucks as a “third<br />

place”. Instead of trying to force onto the<br />

market the same products that work in<br />

the U.S., such as whip cream-covered<br />

frozen coffee concoctions, Starbucks<br />

developed flavours, such as green teaflavoured<br />

coffee drinks, that appeal to<br />

local tastes. Rather than pushing take-out<br />

orders, Starbucks adapted to Chinese<br />

local consumer wants and promoted dinein<br />

service.<br />

So What Do Successful Brands Have<br />

in Common?<br />

Consistency - When consumers come<br />

back to a business for repeat sales,<br />

they usually expect to receive the same<br />

level of quality as they did the first time.<br />

No one wants to deal with a company<br />

they can’t rely on for consistency. With<br />

so many industries being saturated<br />

with competitors, inconsistency is often<br />

enough of a reason for consumers to<br />

take their business elsewhere. That’s<br />

why it’s so important to adhere to a<br />

certain quality standard with a product or<br />

service e.g. McDonald’s.<br />

Starbucks also believe in branding<br />

themselves globally via maintaining brand<br />

integrity. One of Starbucks’ best practices<br />

is to send their best baristas from<br />

established markets to new markets and<br />

train new employees. These baristas act<br />

a revolutionary idea. It simply needs to<br />

have one special thing that separates it<br />

Competitiveness - Gaining an edge in<br />

today’s business world isn’t easy. For a<br />

brand to make a name for itself, team<br />

members should thrive on competition<br />

and constantly strive to improve. When<br />

it comes to the major players in any<br />

industry, none simply sit back and hope<br />

that their consumers will do the work<br />

for them. Instead, they tend to be the<br />

movers and shakers who work tirelessly<br />

toward building and optimizing their<br />

brand, going above and beyond consumer<br />

expectations. The end result tends to be<br />

a brand that is continually on the cutting<br />

Audience Knowledge - The best<br />

brands have a thorough understanding<br />

of the demographics of their target<br />

the gap between small companies and<br />

large ones. By developing a presence on<br />

networks like Facebook, Twitter, LinkedIn<br />

and Google+, anyone is able to reach<br />

almost any consumer.<br />

In conclusion, today’s franchisees have<br />

access to greater amounts of information<br />

faster than ever before. With pervasive<br />

social media tools and the current<br />

trend of web and video blogging, brand<br />

managers are met with an ever increasing<br />

number of threats to maintaining their<br />

brand’s image and credibility. This is<br />

particularly challenging for franchising<br />

How do you know when you have found the right<br />

franchise for you?<br />

1. Growth potential in the market<br />

The concept should have a sustainable growth potential in the<br />

market at a local, national and international level. The analysis<br />

or market research for this should be provided by the franchisor.<br />

However, it is equally important to conduct a separate research<br />

about the market growth and potential future competition,<br />

especially at the local level, by gathering information from the<br />

web, family and friends. Ensure that the concept is suited to<br />

the locale targeted for franchise business, even if it has been<br />

successful in some other part of the country or state.<br />

4. Marketing and advertising support<br />

The marketing needs have to be understood in detail. Some of<br />

the aspects to be considered are:<br />

• What are the type of marketing, sales building, advertising<br />

programmes and resources provided by the franchisor?<br />

• Is the franchisor responsible for ensuring that the marketing<br />

and promotional campaigns are more effective than those of<br />

the competitors?<br />

• Does the franchisor leverage the power of online marketing<br />

and social media?<br />

• Would there be a monthly deduction towards a separate<br />

marketing fund managed by the franchisor? How is the fund<br />

managed? What is ROI for the fund?<br />

2. Controlled growth of the franchise network<br />

Analyse the nature of growth sustained in previous years. An<br />

incremental growth in the number of franchise units is a good<br />

indicator of future profitable growth. Also, the more the number<br />

of units, the greater the brand awareness among the customers.<br />

Be cautious if the past records show rapid or exponential growth.<br />

Dig deeper into the franchisor’s recruiting or selling approach<br />

and ability to support a rapidly growing network of fledgling<br />

businesses.<br />

3. Ongoing franchisor support<br />

Ensure that the franchisor provides comprehensive training,<br />

operations and business building support to help get the<br />

franchise established and to keep it sustainable and profitable.<br />

The franchisor should also be actively involved in keeping<br />

the business at the cutting edge of product development,<br />

management approach, and compliance.<br />

5. Satisfied and enthused franchisees<br />

Talking to the past and current franchisees will help in<br />

understanding the challenges involved in the franchise business<br />

and issues to be tackled. It is important to take the responses<br />

with a pinch of salt as not all franchisee businesses can be<br />

expected to be equally successful. But, if the predominant<br />

opinion is negative, then it might be better to not enter the<br />

Information Disclosure Document from the franchisor. It is also a<br />

performance. Review the figures with an accountant and evaluate<br />

the potential performance that can be achieved in the locality<br />

chosen for business.<br />

While reviewing the franchisor’s historical financial performance<br />

figures, ensure that the past and current accounting practices<br />

are sound and financially<br />

robust so as to support the<br />

growth of their business and<br />

ultimately the growth of the<br />

franchisees under them.<br />

9. Franchisor behaviour -<br />

Integrity, transparency<br />

& honesty<br />

The franchisor’s behaviour<br />

while responding to questions about profitability, sustainability<br />

and other important matters is a good indication of the support<br />

that can be expected at a later stage while running the business.<br />

Make sure the requests for information are responded to in a<br />

clear and speedy manner, with valid responses. Any grey areas,<br />

omissions, suspicious activity or lack of transparency is a<br />

red flag.<br />

7. A reputable management team<br />

Be familiar with the management team of the franchisor and<br />

try to establish a rapport with them, as this working relationship<br />

will prove to be critical after starting the franchise. Look at the<br />

company’s past, its founders or master franchisees and their<br />

business acumen. Find out how long the company has been<br />

franchising.<br />

10. A substantial system<br />

A strong and robust system will provide the franchisees with<br />

all of the operations systems, software, training programmes,<br />

equipment (in some cases) and monitoring tools to establish a<br />

sound business. Ensure all of this is in place. Make sure that a<br />

strong and fair franchise agreement is put together, so that it<br />

not only protects the brand and franchisor, but also providesthe<br />

business support, compliance protection, brand and product<br />

development that will help grow a sustainable business. It<br />

is important to review the agreement with a solicitor with<br />

franchise experience.<br />

Why Eye Level Franchise?<br />

When I was younger, I wanted to become my own boss or a business<br />

owner. I wished to be involved in something that can bring goodwill<br />

to our society. With that aim, I ventured into financial consulting for<br />

the past 10 years to educate people about asset protection, family<br />

protection and the importance of saving.<br />

As I grew older, got married and have my own children, I became<br />

interested on children related business. My cousins were with<br />

Eye Level since 2006. Through them, I could see improvement in<br />

their math skills. Not only that, they also possess a very positive<br />

attitude in problem solving. When I was exploring children related<br />

business, Eye Level was the first in my mind. I love children and I<br />

believe every child deserves a bright future.<br />

Education is the main key for children to achieve their goals and to<br />

be able to contribute back to the world. With a proven education<br />

system and market experience in Eye Level, I believe I could obtain<br />

guidance to run my own business although I did not have any<br />

experience in running a children enrichment center.<br />

Can you tell us reasons for this growth in<br />

unconventional sectors in the franchising<br />

and licensing industry<br />

The ease of information and many alternative forms of<br />

communication are playing an important role in the growth of<br />

all business sectors around the world, and the franchising and<br />

licensing industry is no exception.<br />

Nowadays, new and existing business owners have already made<br />

it a norm to constantly embark on new innovations. They are<br />

more open to change management and the realisation of having<br />

better documentation of standard operating procedures in their<br />

current business. They have started to realise that franchising<br />

and licensing could be another option for them to expand their<br />

businesses and are more willing to explore and invest in this<br />

business model. While the Education and F&B sectors remain<br />

strong, other unconventional sectors are also gaining momentum<br />

in luring more potential franchisees and investors into their<br />

respective sectors.<br />

Share with us some insight into the<br />

franchising and licensing landscape in<br />

We all know for a fact that the F&B sector in the franchising<br />

landscape in Singapore has always been strong. The Education<br />

sector continues to increase in momentum, especially as the<br />

demand for this sector has gained more interest in recent years.<br />

The Healthcare, Lifestyle and Property industries are some other<br />

sectors that are also moving up the ladder as well. In general,<br />

potential franchisees and investors are more open to considering<br />

franchises and licenses from various sectors. They are also more<br />

knowledgeable about utilising this type of business model for<br />

expansion, both locally and internationally.<br />

How is this stimulating the franchising<br />

and licensing landscape?<br />

We will see more companies from different industries considering<br />

franchising and licensing as another additional business model.<br />

Current franchisors or franchisees will also go into other similar, or<br />

even unconventional sectors – mainly to diversify their business.<br />

Furthermore, we will see more people being trained and educating<br />

themselves on franchising and licensing to improve or embark in<br />

Dancing Crab –<br />

Grooving to the Top!<br />

Dancing Crab, a Louisiana-style eatery, was crowned the overall winner in the<br />

‘Promising Franchisor of the Year’ category in the recent FLA awards 2015.<br />

Within one short year, Dancing Crab has expanded to five locations, including<br />

Tokyo, Osaka, Sumatra, with an outlet in Australia scheduled to open in <strong>2016</strong>.<br />

Said Norman Hartono, General Manager of Dancing Crab, “Winning the overall<br />

‘Promising Franchisor of the Year’ award was unexpected and it is a huge<br />

encouragement to know that we are heading in the right direction. When I<br />

began in this line, I did not know anything about franchising and licensing at all,<br />

but have FLA to thank for providing me with invaluable lessons to kick-start this<br />

journey. My advice to anyone looking to develop his or her brand into a franchise<br />

is to not give up. Singapore is a tough market but continue persevering and you<br />

can go anywhere in the world.”<br />

Can you name some of the factors that<br />

contributed to Dancing Crab’s exciting<br />

growth?<br />

Some factors that have contributed to the growth of Dancing<br />

Crab’s brand could be attributed to our unique franchise model<br />

as well as the support of a central kitchen.<br />

Unlike other franchise models that require ingredients and core<br />

items to be produced and purchased from the main franchisor,<br />

we tailor each outlet to suit the local food climate and use local<br />

ingredients to maintain the freshness and sustainability of both<br />

the food and business of our franchisees. Locally in Singapore,<br />

we have the support of a central kitchen that produces our core<br />

selling items to maintain food consistency and to help ease our<br />

manpower needs.<br />

How does Dancing Crab stand out from<br />

the competitors?<br />

Although the eating style of the Cajun seafood concept is already<br />

unique on its own, we still treat ourselves as a serious restaurant<br />

where food quality and service is paramount over everything<br />

else. That is why every outlet sells only the freshest seafood<br />

as well as authentic Cajun/Creole favorites such as gumbo,<br />

jambalaya and po’ boys, amongst others, that stand up to those<br />

found in New Orleans.<br />

What are some of the setbacks and<br />

challenges faced by Dancing Crab when<br />

starting out in franchising? And how did<br />

you overcome them?<br />

One challenge we faced during the starting phases of franchising<br />

Dancing Crab was to create scalability for the brand and the<br />

product of Dancing Crab. We tried to mass produce our core<br />

products, but the quality was not up to our standards. As a result,<br />

we decided to tailor each franchise by using the local ingredients<br />

and produce available from our franchisees to create the exact<br />

same taste found in any Dancing Crab outlet in the world.<br />

If you had to start over, would you do<br />

anything differently?<br />

No, I would not.<br />

What is in the pipeline for Dancing Crab?<br />

Next in the pipeline would be for us to expand the brand further<br />

into more countries, as well as to help develop our current<br />

overseas partners into master franchisees where they are able to<br />

independently take on and expand within their respective regions.<br />

What would your advice be for someone<br />

starting off in the franchise business?<br />

Do not ever compromise on the core concept of your business,<br />

keep evolving your brand and keep it simple to increase the<br />

scalability of your franchise.<br />

Before you consider investing in a franchise business you<br />

should understand the concept of franchising and you should<br />

understand the brand that you are considering investing in and<br />

the people behind it.<br />

In simple terms franchising is just a method of doing business, a<br />

method of marketing products and services which is now being<br />

used across an ever growing variety of industries and businesses.<br />

Although most people credit the invention of franchising to<br />

American commerce the word “franchise” is derived from the<br />

French word “franchir”, which means “to be free – exempt from<br />

servitude” which is appropriate because franchising offers you<br />

the freedom to own and operate your own business. In any<br />

event franchising in this millennium has no nationality, religion,<br />

race, colour or creed and the application of the franchise<br />

business model has been adopted worldwide.<br />

In a franchise business relationship the brand owner is the<br />

franchisor and the party that owns the right to the tradename,<br />

trademarks and intellectual property of the business and you<br />

as the franchisee are the party that is granted the right to use<br />

the trademarks and intellectual property of business for a<br />

predetermined period of time and in a predetermined location<br />

or geographical area.<br />

In its ideal state, a franchise is the “marriage” of an<br />

entrepreneurial company with a proven business system and<br />

a hard-working, local independent business owner willing to<br />

follow that proven system. The “marriage” is a contractual<br />

relationship spelled out in a written franchise agreement which<br />

details the rights and obligations of both parties.<br />

There are various types of franchise agreements depending<br />

on the brand, the nature of the franchise arrangement and the<br />

development and geographical scope of the arrangement. The<br />

most common types of franchise agreements are the single<br />

unit/business franchise agreement, a multi- unit/business<br />

franchise agreement typically called an area developer<br />

agreement and a multi- unit/business franchise agreement<br />

that allows for 2 tiers of franchising typically called a master<br />

and understand yourself and you should ask and answer the<br />
