f. Single-Use Buildings may be adjacent to structures with different uses (such as Residential next to Retail), provided that the Single-Use Buildings are compatible with each other. Since these Guidelines encourage a walkable environment, a horizontal mixed-use approach is an acceptable approach to achieving this goal, provided sidewalks and pedestrian pathways are provided. g. Parking structures are the preferred parking facility to serve the Indigo Ridge Development, especially in Mixed-Use and Transit-Oriented Development areas. h. Surface parking is permitted, including on-street parking and off-street parking lots. While not specifically prohibited, the development of large off-street Surface Parking Lots is discouraged in favor of parking structures. 1.4 APPLICATION The following basic steps should be followed to determine the uses and development standards applicable to all parcels within the Indigo Ridge Development. These Guidelines explain where the building will sit on the lot, the limits on its Three (3) dimensional form, the range of uses, and the palette of materials that will cover it: a. Locate the subject parcel in the Indigo Ridge Development Plan; b. Identify the District in which the parcel is located; c. Identify the required street standards along all its frontages; d. Identify any special frontage requirements that may be applicable to the subject parcel; e. Review the Permitted Land Uses by District (Figure 3.1) to determine allowed uses; and, f. Examine the corresponding development standards to determine the applicable building. 1.5 EXEMPTIONS, VARIANCES, WAIVERS, AND MINOR MODIFICATIONS All previous development standards for the Property are replaced with these Guidelines and standards. Exemptions, variances and waivers from these Guidelines are considered as follows: a. Development Review Committee – As detailed in the Master Declaration of Covenants, Conditions and Restrictions for Indigo Ridge (CC&R), a Development Review Committee (DRC) shall review all proposed developments for consistency and compliance with the applicable guidelines and requirements. b. Variances – Should a developer desire to vary from these requirements, he/she may request an exemption, variance or waiver to be considered for review and approval by the DRC: 1) The DRC may grant reasonable variances or adjustments from these Guidelines in its reasonable discretion. The DRC is under no obligation to grant these variance requests and shall consider them only in the context of their impact on the development as a whole; 2) Such variances or adjustments shall be granted only when the granting thereof shall neither be materially detrimental or injurious to the other Lots or Common Area (as defined in the CC&R), nor deviate substantially from the general intent and purpose of these Guidelines or the CC&R. Each variance must also be recorded at the expense of the Property Owner requesting the variance; provided, however, that failure to record a variance will not affect the validity thereof or give rise to any claim or cause of action against the DRC; 3) Upon recordation of the variance, the Property Owner shall provide a copy of the recorded variance to the DRC; 4) If a variance is granted, no violation of the covenants, conditions, or restrictions contained in these Guidelines will be deemed to have occurred with respect to the matter for which the variance was granted. The granting of such variance will not operate to waive or amend any of the terms and provisions of these Guidelines for any purpose, except as to the particular property and in the particular instance covered by the variance, and such variance will not be considered to establish a precedent for any future waiver, modification, or amendment of the terms and provisions of these Guidelines; and, Indigo Ridge Development Guidelines Cedar Park, Texas (Draft 29 June 2018) 2
5) No variance or adjustment granted by the DRC shall be deemed to apply to any other building, person, improvement or parcel, other than the Property Owner granted such variance. c. Waivers – As noted in these Guidelines, some design standards are identified as being waived for specific Character Districts. d. Minor Modifications – Minor modifications to these Guidelines must may be considered for approval by DRC without the need for City review and approval. Minor modifications shall include the following: 1) Architectural Development Standards – The DRC may consider requested changes to architectural standards identified in Section 4 of these Guidelines up to Twenty Percent (20%) difference from what is described. Changes beyond these standards are considered Major Modifications and must be approved by the Cedar Park City Manager (or his/her designee) for administrative approval. 2) Roadway Minor Modifications – The DRC may consider a change in roadway location if it is less than One Hundred Feet (100’) in any direction from the location shown on the approved Planned Development or if it does not add or reduce the number of travel lanes in the cross-section. Changes to roadways beyond these standards are considered Major Modifications and must be approved by the City Manager (or his/her designee) for administrative approval. 3) Land Use Minor Modifications – DRC may consider changes to permitted land uses provided it is within the permitted land uses as allowed by the City of Cedar Park Zoning Ordinance. The only exception shall be adding any Residential use outside the Lifestyle Core District (District 4), which will require review and approval by the Cedar Park City Manager (or his/her designee). 4) Landscape and Open Space Minor Modifications – DRC may consider requested changes to landscape and open space standards identified in Section 6 of these Guidelines up to Twenty Percent (20%) difference from what is described. Changes beyond these standards are considered Major Modifications and must be approved by the Cedar Park City Manager (or his/her designee) for administrative approval. 5) Signage Minor Modifications – DRC may consider requested changes to signage standards identified in Section 7 of these Guidelines up to Twenty Percent (20%) difference from what is described. Changes beyond these standards are considered Major Modifications and must be approved by the Cedar Park City Manager (or his/her designee) for administrative approval.
