As this is my last President’s<br />

Message, I’d like to thank all<br />

our members for the honor<br />

and privilege <strong>of</strong> serv<strong>in</strong>g as<br />

your ANA-<strong>Michigan</strong> President.<br />

<strong>The</strong>se past two years have<br />

flown by and it’s been an<br />

excit<strong>in</strong>g opportunity help<strong>in</strong>g<br />

shape our association for<br />

L<strong>in</strong>da Taft, RN<br />

the future, while creat<strong>in</strong>g a<br />

member-centered, relevant, responsive and valuebased<br />

membership. We’ve grown <strong>in</strong> strength,<br />

<strong>in</strong>fluence and numbers, forged new partnerships<br />

and nurtured past collaborations, all while<br />

cont<strong>in</strong>u<strong>in</strong>g to build on the groundwork we’ve laid<br />

s<strong>in</strong>ce becom<strong>in</strong>g ANA-<strong>Michigan</strong>!<br />

In 2016, the Governance Task Force<br />

researched the overall functionality, efficiency<br />

and susta<strong>in</strong>ability <strong>of</strong> the association <strong>in</strong> the<br />

areas <strong>of</strong> structure, engagement and f<strong>in</strong>ancials.<br />

<strong>The</strong>se f<strong>in</strong>d<strong>in</strong>gs were presented to the Board <strong>of</strong><br />

Directors and f<strong>in</strong>al reports were shared with the<br />

membership at our 2017 ANA-<strong>Michigan</strong> Annual<br />

Assembly. Through action by the membership, our<br />

Board <strong>of</strong> Directors were charged with explor<strong>in</strong>g<br />

restructur<strong>in</strong>g options and to present them at the<br />

<strong>2018</strong> ANA-<strong>Michigan</strong> Annual Assembly. With <strong>in</strong>put<br />

from our board, councils, committees, members<br />

and staff, we are now poised to complete the<br />

restructur<strong>in</strong>g process with the proposed Bylaws<br />

Amendments presented to the membership.<br />

<strong>The</strong> proposals have gone out to the membership<br />

electronically, with opportunity for comments and<br />

feedback. <strong>The</strong>se proposals are also outl<strong>in</strong>ed <strong>in</strong> this<br />

publication. Vot<strong>in</strong>g on the proposals will occur at<br />

our Annual Assembly on Friday, October 26, <strong>2018</strong><br />

at the Royal Park Hotel <strong>in</strong> Rochester, MI. I hope<br />

you will all take the time to review the proposals<br />

and attend the Annual Assembly to vote – along<br />

with attend<strong>in</strong>g our excit<strong>in</strong>g conference, Honor<strong>in</strong>g<br />

the Past, Celebrat<strong>in</strong>g the <strong>Future</strong>. An awards d<strong>in</strong>ner<br />

is also scheduled for Thursday, October 25.<br />

Why is this important to you, our member?<br />

This is a major undertak<strong>in</strong>g <strong>in</strong> rebuild<strong>in</strong>g from the<br />

ground up. In today’s association world, there is an<br />

<strong>in</strong>creas<strong>in</strong>g focus on be<strong>in</strong>g nimble and responsive<br />

to both members and issues, cost efficient with<br />

time and resources, and lead<strong>in</strong>g “from the outside<br />

<strong>in</strong>” to meet the needs <strong>of</strong> our members. Our<br />

focus <strong>in</strong> the proposed restructur<strong>in</strong>g changes is to<br />

become an association that reflects these goals<br />

and values. Our research shows that the outreach<br />

to the local level <strong>in</strong> other associations has many<br />

variations and many have found that members<br />

are not as focused on “bus<strong>in</strong>ess meet<strong>in</strong>gs,” but<br />

do desire access to quality educational <strong>of</strong>fer<strong>in</strong>gs,<br />

network<strong>in</strong>g opportunities and advocacy activities.<br />

We’ve heard from so many <strong>of</strong> you, you’ve<br />

expressed that you’d love to be more <strong>in</strong>volved, but<br />

cannot always commit to the large blocks <strong>of</strong> time<br />

or that the opportunities are not available <strong>in</strong> your<br />

membership area. Conversely, it’s been a challenge<br />

to fully activate some <strong>of</strong> our Regions, Councils<br />

and Committees due to a lack <strong>of</strong> volunteers.<br />

Council and committee work will cont<strong>in</strong>ue with<br />

restructur<strong>in</strong>g, elim<strong>in</strong>at<strong>in</strong>g many <strong>of</strong> the barriers<br />

and obstacles that allow for more fluid member<br />

<strong>in</strong>volvement. We will be able to provide more<br />

consistent programm<strong>in</strong>g and opportunities for<br />

our members as their time, <strong>in</strong>terest, expertise and<br />

level <strong>of</strong> commitment allow. Ample opportunity<br />

will still exist to develop leadership skills, mentor<br />

others and advocate for <strong>Nurs<strong>in</strong>g</strong> and health<br />

care <strong>in</strong> a variety <strong>of</strong> ways through development<br />

<strong>of</strong> pr<strong>of</strong>essional issues panels, special or mutual<br />

<strong>in</strong>terest groups and task forces.<br />

In center<strong>in</strong>g our resources at the state level, we<br />

can be more responsive to the entire membership<br />

around the state. Manag<strong>in</strong>g our resources<br />

responsibly is critical to our success. Reduc<strong>in</strong>g the<br />

size <strong>of</strong> our Board <strong>of</strong> Directors will be more cost<br />

effective, and transition the board to be<strong>in</strong>g fully<br />

Northern <strong>Michigan</strong> Shows Def<strong>in</strong><strong>in</strong>g Hope<br />

In June, Region 2 took advantage <strong>of</strong> ANA-<br />

<strong>Michigan</strong>’s purchase <strong>of</strong> the rights to <strong>of</strong>fer<br />

free public screen<strong>in</strong>gs <strong>of</strong> the prize-w<strong>in</strong>n<strong>in</strong>g<br />

documentary, Def<strong>in</strong><strong>in</strong>g Hope. <strong>The</strong> film focuses on<br />

eight patients with life-threaten<strong>in</strong>g illness and the<br />

nurses who guide them to make critical choices<br />

along the way as they face death, embrace hope<br />

and ultimately redef<strong>in</strong>e what makes life worth<br />

liv<strong>in</strong>g.<br />

It tells the stories <strong>of</strong> patients mak<strong>in</strong>g choices<br />

about how they want to live, how much medical<br />

technology they can accept, what they hope for<br />

and how that hope evolves. It is about optimism<br />

and helps us def<strong>in</strong>e what “quality <strong>of</strong> life” really<br />

means. As nurses we <strong>of</strong>ten see that end <strong>of</strong> life<br />

the Executive Committee and Directors at Large<br />

from the state, <strong>in</strong>clud<strong>in</strong>g a Director position for<br />

a nurse <strong>in</strong> practice with less than five years. This<br />

encourages our association to strengthen our<br />

relationship with <strong>Michigan</strong> <strong>Nurs<strong>in</strong>g</strong> Students<br />

Association (MNSA) and new to practice nurses<br />

as they transition and become pr<strong>of</strong>icient <strong>in</strong> their<br />

career.<br />

While grow<strong>in</strong>g our membership is always<br />

the priority, we’ve also made strides <strong>in</strong> utiliz<strong>in</strong>g<br />

electronic communication and virtual meet<strong>in</strong>g<br />

capabilities when possible to reduce meet<strong>in</strong>g costs<br />

and are actively seek<strong>in</strong>g out non-dues revenue<br />

sources <strong>of</strong> <strong>in</strong>come. Develop<strong>in</strong>g best practices and<br />

adher<strong>in</strong>g to association standards <strong>of</strong> excellence is<br />

a priority. With our association management team,<br />

led by Tobi Moore, Executive Director, we’re able<br />

to access many resources we wouldn’t be able to<br />

otherwise, and it’s reflected <strong>in</strong> the work we do and<br />

the relationships we’ve formed. Nationally with<br />

ANA, we can participate on an expanded level and<br />

<strong>in</strong>fluence policy and programm<strong>in</strong>g to benefit us all<br />

personally and pr<strong>of</strong>essionally.<br />

In the boardroom, classroom, community,<br />

cl<strong>in</strong>ic, or bedside and beyond, I’m so proud <strong>of</strong> our<br />

accomplishments these past two years. Becom<strong>in</strong>g<br />

the “convener <strong>of</strong> conversations” is <strong>in</strong>tegral to the<br />

work <strong>of</strong> our association and we are present at<br />

more tables than ever. Our membership cont<strong>in</strong>ues<br />

to grow, and we must now adapt to meet the<br />

needs <strong>of</strong> those members <strong>in</strong> a mean<strong>in</strong>gful and<br />

purposeful way. Jo<strong>in</strong> us at our ANA-<strong>Michigan</strong><br />

Annual Meet<strong>in</strong>g on Friday, October 26, to set our<br />

path to the future!<br />

ANA-<strong>Michigan</strong>:<br />

Advanc<strong>in</strong>g the nurs<strong>in</strong>g pr<strong>of</strong>ession <strong>in</strong> <strong>Michigan</strong><br />

choices are <strong>of</strong>ten avoided, and our hope is that<br />

see<strong>in</strong>g this film will prompt discussions with<strong>in</strong><br />

families at an earlier po<strong>in</strong>t and to see that it is not<br />

a onetime discussion.<br />

Our audience was composed <strong>of</strong> a mix <strong>of</strong> nurses<br />

and their potential patients. Follow<strong>in</strong>g the film, a<br />

panel – Stephanie VanSlyke, RN, Roman Barraza,<br />

MD and Rev. Bonnie Smith, RN – answered<br />

questions and shared their experiences with<br />

patients at the end <strong>of</strong> life. <strong>The</strong> general responses<br />

to the film and panel were positive and there was<br />

discussion <strong>of</strong> show<strong>in</strong>g the film <strong>in</strong> other venues.<br />

Could You Be Fac<strong>in</strong>g a Pr<strong>of</strong>essional Licensure Investigation?<br />

Part III You’ve Been Interviewed by the Investigator, Now What?<br />

This article is the third <strong>in</strong>stallment <strong>in</strong> a four part series<br />

address<strong>in</strong>g health pr<strong>of</strong>essional licensure <strong>in</strong>vestigations<br />

and adm<strong>in</strong>istrative actions <strong>in</strong> <strong>Michigan</strong>. In the first<br />

article <strong>in</strong> the series, how licens<strong>in</strong>g <strong>in</strong>vestigations are<br />

<strong>in</strong>itiated and the factors that go <strong>in</strong>to the <strong>in</strong>itiation <strong>of</strong><br />

a pr<strong>of</strong>essional licensure <strong>in</strong>vestigation were discussed.<br />

In the second article, I discussed the health care<br />

pr<strong>of</strong>essional’s rights when be<strong>in</strong>g <strong>in</strong>terviewed by an<br />

<strong>in</strong>vestigator from the Department <strong>of</strong> Licens<strong>in</strong>g and<br />

Regulatory Affairs, Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g.<br />

In this third <strong>in</strong>stallment <strong>in</strong> the four part series, I will<br />

discuss the important steps a health care pr<strong>of</strong>essional should take after an<br />

<strong>in</strong>vestigator’s <strong>in</strong>terview and the <strong>in</strong>ternal review the Bureau <strong>of</strong> Pr<strong>of</strong>essional<br />

Licens<strong>in</strong>g takes after the <strong>in</strong>vestigation is completed.<br />

Follow<strong>in</strong>g the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g <strong>in</strong>vestigator’s <strong>in</strong>terview, it<br />

is important the health care pr<strong>of</strong>essional take steps to ensure the Bureau <strong>of</strong><br />

Pr<strong>of</strong>essional Licens<strong>in</strong>g’s file reflects the statements made by the health care<br />

pr<strong>of</strong>essional dur<strong>in</strong>g the <strong>in</strong>terview. While the <strong>in</strong>vestigator will generally take<br />

notes dur<strong>in</strong>g the <strong>in</strong>terview, there are no assurances that the notes taken by<br />

the <strong>in</strong>vestigator will reflect all <strong>of</strong> the <strong>in</strong>formation provided by the health care<br />

pr<strong>of</strong>essional. Regardless <strong>of</strong> how good a note taker the <strong>in</strong>vestigator is, he/she<br />

may not view certa<strong>in</strong> statements by the health care pr<strong>of</strong>essional with the<br />

same weight as were <strong>in</strong>tended. For these reasons, a health care pr<strong>of</strong>essional<br />

is encouraged to provide his/her own written summary so that the summary<br />

becomes a permanent part <strong>of</strong> the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g’s file.<br />

Provid<strong>in</strong>g a summary <strong>of</strong> the <strong>in</strong>terview, close <strong>in</strong> time to the <strong>in</strong>terview, will<br />

accomplish three goals. First, it will capture all the po<strong>in</strong>ts the health care<br />

pr<strong>of</strong>essional wants to clarify or emphasize. Second, the summary may also<br />

memorialize po<strong>in</strong>ts made dur<strong>in</strong>g the <strong>in</strong>terview that could require more<br />

<strong>in</strong>vestigation and follow up by the <strong>in</strong>vestigator, especially if new <strong>in</strong>dividuals<br />

need to be <strong>in</strong>terviewed or prior witnesses need to be re-<strong>in</strong>terviewed. Third,<br />

and most importantly, the health care pr<strong>of</strong>essional’s summary can boost<br />

his/her credibility. From a credibility standpo<strong>in</strong>t, a health care pr<strong>of</strong>essional’s<br />

memorialized recollection is more believable when done close <strong>in</strong> time to the<br />

<strong>in</strong>terview rather than months later after an adm<strong>in</strong>istrative compla<strong>in</strong>t is filed<br />

by the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g and the health care pr<strong>of</strong>essional<br />

discovers that his/her recollection is <strong>in</strong>consistent with the notes taken by the<br />

<strong>in</strong>vestigator dur<strong>in</strong>g the <strong>in</strong>terview.<br />

Once the <strong>in</strong>vestigator has completed his/her <strong>in</strong>terviews, gathered<br />

appropriate documents and re-<strong>in</strong>terviewed <strong>in</strong>dividuals, if applicable,<br />

the matter is reviewed by the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g for a<br />

determ<strong>in</strong>ation as to whether the health care pr<strong>of</strong>essional’s actions or<br />

<strong>in</strong>actions are a violation <strong>of</strong> <strong>Michigan</strong>’s public health code. <strong>Michigan</strong> law<br />

states that the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g has 90 days <strong>in</strong> which to<br />

complete the <strong>in</strong>vestigation. While the Bureau <strong>of</strong> Licens<strong>in</strong>g may extend that<br />

Washtenaw-Liv<strong>in</strong>gston-Monroe District Nurses<br />

Association existed, I was a member <strong>of</strong> the Board<br />

<strong>of</strong> Directors and was the Chair <strong>of</strong> the MNA Cab<strong>in</strong>et<br />

on Adm<strong>in</strong>istration and Education and an MNA<br />

delegate <strong>in</strong> the early to mid-1990’s.<br />

not prepare Nurse Practitioners for the work<strong>in</strong>g<br />

environment and the programs need to be evaluated<br />

and critiqued more to ensure we are hav<strong>in</strong>g properly<br />

educated Nurse Practitioner graduates. Today’s<br />

Nurse Practitioners must be educated to practice<br />

medic<strong>in</strong>e on top <strong>of</strong> the licensure.”<br />

6:00 p.m. followed by the awards program from 7:00<br />

to 8:00 pm. <strong>The</strong> even<strong>in</strong>g <strong>of</strong> celebration will conclude<br />

with an <strong>in</strong>spirational message from, Patricia D. Hurn,<br />

PhD, RN, FAAN, regard<strong>in</strong>g the opportunities <strong>in</strong><br />

nurs<strong>in</strong>g, what #besideandbeyond means <strong>in</strong> her world<br />

and how you can apply it to yours.<br />

Exceptional Promise Award aims to spotlight five<br />

and promise for tomorrow. ANA-<strong>Michigan</strong> will<br />

recognize five (5) dist<strong>in</strong>guished nurs<strong>in</strong>g students<br />

who exemplify leadership and achievement <strong>in</strong> their<br />

community and their scholarly efforts. <strong>The</strong> purpose<br />

is <strong>in</strong>tended to celebrate and encourage exemplar<br />

dedication to the nurs<strong>in</strong>g pr<strong>of</strong>ession.<br />

• Prelicensed nurs<strong>in</strong>g student at the time the<br />

nom<strong>in</strong>ation is made.<br />

• Significantly or uniquely contributes to<br />

• Demonstrates leadership <strong>in</strong> community affairs,<br />

Celebrat<strong>in</strong>g the <strong>Future</strong><br />

Celebrat<strong>in</strong>g the <strong>Future</strong> Award aims to recognize<br />

and acknowledge five (5) nurses <strong>in</strong> <strong>Michigan</strong> who<br />

have demonstrated outstand<strong>in</strong>g achievement <strong>in</strong><br />

nurs<strong>in</strong>g that have been a licensed RN for five years<br />

or less. This award is <strong>in</strong>tended to celebrate dedicated<br />

service, encourage exemplary commitment to<br />

the nurs<strong>in</strong>g pr<strong>of</strong>ession, and promise to grow<br />

<strong>in</strong> leadership <strong>in</strong> the advancement <strong>of</strong> nurs<strong>in</strong>g <strong>in</strong><br />

<strong>Michigan</strong>.<br />

Criteria to Include:<br />

• Currently licensed as an RN <strong>in</strong> the state <strong>of</strong><br />

<strong>Michigan</strong>.<br />

• Employed <strong>in</strong> nurs<strong>in</strong>g pr<strong>of</strong>ession for five (5)<br />

years or less.<br />

• Significantly or uniquely contributes to<br />

leadership with<strong>in</strong> the nurs<strong>in</strong>g pr<strong>of</strong>ession<br />

through cl<strong>in</strong>ical practice, education and<br />

teach<strong>in</strong>g, adm<strong>in</strong>istrative leadership, research,<br />

writ<strong>in</strong>g, publish<strong>in</strong>g, policy <strong>in</strong>volvement, and/or<br />

healthcare <strong>in</strong>novation.<br />

• Demonstrates leadership <strong>in</strong> community affairs,<br />

been practic<strong>in</strong>g for 30 or more years. This award is<br />

<strong>in</strong>tended to celebrate the dedication, exemplary<br />

commitment, and significant contribution for a<br />

significant period to the nurs<strong>in</strong>g pr<strong>of</strong>ession <strong>in</strong><br />

<strong>Michigan</strong>.<br />

Criteria to Include:<br />

• This nom<strong>in</strong>ee may be active or retired from<br />

nurs<strong>in</strong>g.<br />

• Demonstrated <strong>in</strong>novative strategies they have<br />

made over their nurs<strong>in</strong>g career.<br />

• Consistently surpass expectations <strong>of</strong> a<br />

pr<strong>of</strong>essional nurse; thus, enhanc<strong>in</strong>g the image<br />

Dorothea Milbrandt Nurse Leader<br />

<strong>The</strong> Dorothea Milbrandt Nurse Leader Award<br />

has been created to honor nurses who have<br />

demonstrated excellence <strong>in</strong> build<strong>in</strong>g successful<br />

mentor<strong>in</strong>g relationships with other nurses and/or<br />

nurs<strong>in</strong>g students. This award is presented on behalf<br />

<strong>of</strong> the late Dorothea Milbrandt, RN, MPS, MSN, who<br />

had an important and last<strong>in</strong>g impact on nurs<strong>in</strong>g <strong>in</strong><br />

<strong>Michigan</strong> for nearly 40 years. She served as Interim<br />

and Associate Executive Director <strong>of</strong> the <strong>Michigan</strong><br />

Nurses Association, Course Director at Lans<strong>in</strong>g<br />

Community College, Board member at Ingham<br />

County Health Education Coalition, Appraiser ANA<br />

Magnet Hospital Recognition Program, Associate<br />

Pr<strong>of</strong>essor at <strong>Michigan</strong> State University, and Vice<br />

President for <strong>Nurs<strong>in</strong>g</strong> at Ingham Medical Center <strong>in</strong><br />

Lans<strong>in</strong>g, <strong>Michigan</strong>. In 2005, she was <strong>in</strong>strumental <strong>in</strong><br />

the found<strong>in</strong>g <strong>of</strong> the Registered Nurses Association <strong>in</strong><br />

<strong>Michigan</strong>, now known as ANA-<strong>Michigan</strong>.<br />

NURSES MOBILIZE FOR ADVOCACY ON CAPITOL HILL<br />

Over 300 nurses from forty-five states jo<strong>in</strong>ed<br />

staff and directors <strong>of</strong> ANA on Capitol Hill June<br />

21, <strong>2018</strong>. Included <strong>in</strong> those nurses were four from<br />

<strong>Michigan</strong>: L<strong>in</strong>da Taft, MaryLee Pakieser, Julia<br />

Stocker Schneider and Tobi Moore.<br />

<strong>The</strong> day began with an orientation and<br />

discussion <strong>of</strong> the bills ANA is focus<strong>in</strong>g on<br />

now. This year and each year the ANA<br />

lobbies for fund<strong>in</strong>g for Title VIII <strong>Nurs<strong>in</strong>g</strong><br />

Workforce Reauthorization Act. This<br />

act provides grants and scholarships<br />

for Advanced Education <strong>in</strong> <strong>Nurs<strong>in</strong>g</strong>,<br />

Workforce Diversity, Nurse Education,<br />

Practice, and Retention Grants and the<br />

National Nurse Service Corps.<br />

ANA supports a Safe Staff<strong>in</strong>g for<br />

Nurse and Patient Safety Act (HR<br />

5052/S 2446). This act does not set a<br />

ratio <strong>of</strong> nurse to patients, but seeks to<br />

put nurses at the table for decisions<br />

regard<strong>in</strong>g staff<strong>in</strong>g issues by creat<strong>in</strong>g<br />

nurse staff<strong>in</strong>g plans that are unit specific<br />

and establish<strong>in</strong>g a committee composed<br />

<strong>of</strong> at least 55 percent direct care nurses<br />

<strong>in</strong> Medicare-participat<strong>in</strong>g hospitals.<br />

Addiction Treatment Access<br />

Improvement Act <strong>of</strong> 2017 (S 2317/HR<br />

3692) and HR 6 will <strong>in</strong>crease the number<br />

<strong>of</strong> practitioners that can provide access to much<br />

needed medication-assisted treatment (MAT).<br />

<strong>The</strong> bill extended the option for NP’s and PA’s<br />

and added registered nurse midwives (treat<strong>in</strong>g<br />

drug addicted pregnant woman and mothers),<br />

certified registered nurse anesthetists and cl<strong>in</strong>ical<br />

nurse specialists. This bill will open access for<br />

MAT treatment for many persons suffer<strong>in</strong>g from<br />

addiction. It passed the House the day after we<br />

were at the Capitol.<br />

<strong>The</strong> last item ANA was look<strong>in</strong>g for assistance<br />

with was to give fund<strong>in</strong>g for gun research to<br />

the CDC. For years the CDC was prohibited from<br />

research<strong>in</strong>g gun violence. That was reversed this<br />

year, but without fund<strong>in</strong>g, they will not be able to<br />

complete their task.<br />

<strong>Nurs<strong>in</strong>g</strong> is so much more than advocat<strong>in</strong>g for<br />

the patient at the bedside. Advocat<strong>in</strong>g for the<br />

patient and the health <strong>of</strong> the country through<br />

legislation is a duty and an honor. Those <strong>in</strong>terested<br />

<strong>in</strong> becom<strong>in</strong>g more <strong>in</strong>volved with ANA-<strong>Michigan</strong> to<br />

one day jo<strong>in</strong> us on “the Hill.” It is an experience <strong>of</strong><br />

a lifetime!<br />

<strong>2018</strong> ANA Membership Assembly Acts on Current Issues and<br />

Looks to a Bold <strong>Future</strong><br />

Break<strong>in</strong>g news and down-to-the-m<strong>in</strong>ute<br />

updates on major health care and humanitarian<br />

issues added urgency and even greater purpose to<br />

the f<strong>in</strong>al day <strong>of</strong> the American Nurses Association’s<br />

<strong>2018</strong> Membership Assembly, held June 22-23 <strong>in</strong><br />

Wash<strong>in</strong>gton, DC. Eligible Assembly representatives<br />

adopted recommendations from the Pr<strong>of</strong>essional<br />

Policy Committee and elected ANA board and<br />

committee members.<br />

Representatives approved recommendations<br />

that were developed follow<strong>in</strong>g three separate<br />

dialogue forums held the previous day. <strong>The</strong> three<br />

forums focused on: secondary opioid exposure<br />

considerations <strong>in</strong> car<strong>in</strong>g for patients with<br />

overdose; the ANA presidential endorsement<br />

process; and the ANA position statement<br />

Euthanasia, Assisted Suicide, and Aid <strong>in</strong> Dy<strong>in</strong>g.<br />

<strong>The</strong> recommendations call on ANA to:<br />

• Identify <strong>in</strong>formational tools to <strong>in</strong>form<br />

students and nurses about respond<strong>in</strong>g to<br />

patients who have potential opioid overdose,<br />

and advocate for fund<strong>in</strong>g and other support<br />

for research and development <strong>of</strong> evidencebased<br />

protocols regard<strong>in</strong>g opioid overdose.<br />

• Refer consideration <strong>of</strong> the ANA presidential<br />

endorsement procedure back to the ANA<br />

Board <strong>of</strong> Directors for development <strong>of</strong> a<br />

revised proposal follow<strong>in</strong>g further <strong>in</strong>put from<br />

ANA members and stakeholders.<br />

• Incorporate the follow<strong>in</strong>g <strong>in</strong>to a revised<br />

position statement on aid <strong>in</strong> dy<strong>in</strong>g: Nurses<br />

must respect patients’ right to request aid<br />

<strong>in</strong> dy<strong>in</strong>g; nurses must be knowledgeable <strong>of</strong><br />

the law regard<strong>in</strong>g aid <strong>in</strong> dy<strong>in</strong>g <strong>in</strong> the state or<br />

territory <strong>in</strong> which they practice; while nurses<br />

are ethically permitted to participate <strong>in</strong> aid<br />

<strong>in</strong> dy<strong>in</strong>g, <strong>in</strong> states or territories where it is<br />

legal, they reta<strong>in</strong> the right to conscientiously<br />

object; nurses must be able to provide<br />

<strong>in</strong>formation on aid <strong>in</strong> dy<strong>in</strong>g and provide<br />

emotional support to patients and families<br />

who face this decision at the end <strong>of</strong> life.<br />

New leadership<br />

Eligible vot<strong>in</strong>g representatives elected Ernest<br />

Grant, PhD, RN, FAAN, <strong>of</strong> the North Carol<strong>in</strong>a<br />

Nurses Association as the association’s next<br />

president.<br />

ANA’s Membership Assembly also elected four<br />

other members to serve on the n<strong>in</strong>e-member<br />

board <strong>of</strong> directors. <strong>The</strong> newly-elected board<br />

members are: Secretary Stephanie Pierce, PhD,<br />

MN, RN, CNE, <strong>of</strong> the Louisiana State Nurses<br />

Association; Director-at-Large Tonisha Melv<strong>in</strong>, DNP,<br />

CRRN, NP-C, <strong>of</strong> the Georgia Nurses Association;<br />

Director-at-Large Varsha S<strong>in</strong>gh, MSN, APN, <strong>of</strong> the<br />

New Jersey State Nurses Association; Director-at-<br />

Large Staff Nurse Jennifer Gil, BSN, RN, <strong>of</strong> ANA<br />

addressed the Assembly, express<strong>in</strong>g gratitude for<br />

the opportunity. Cole <strong>of</strong>fered her vision <strong>of</strong> a future<br />

where nurses lead. “Our nation and our patients<br />

are count<strong>in</strong>g on us to show up and speak up,” she<br />

said. “We must not fail them. ANA will be there,<br />

and I know you will jo<strong>in</strong> us.”<br />

Celebrat<strong>in</strong>g a victory<br />

ANA jo<strong>in</strong>ed other nurs<strong>in</strong>g organizations<br />

commend<strong>in</strong>g the passage <strong>of</strong> H.R. 6, the SUPPORT<br />

for Patients and Communities Act, which will<br />

extend prescrib<strong>in</strong>g authority to nurses and help<br />

combat the opioid crisis. <strong>The</strong> bill has moved to the<br />

Senate.<br />

By acclamation, the Membership Assembly<br />

endorsed an updated ANA board statement on the<br />

Adm<strong>in</strong>istration’s practice <strong>of</strong> separat<strong>in</strong>g children<br />

from families at the United States border.<br />

A reflection—and a look ahead<br />

ANA President Pamela F. Cipriano, PhD, RN,<br />

NEA-BC, FAAN, also gave her f<strong>in</strong>al Membership<br />

Assembly address. Her term will end at the close<br />

<strong>of</strong> <strong>2018</strong>.<br />

Cipriano, who has been an ANA member s<strong>in</strong>ce<br />

she graduated from nurs<strong>in</strong>g school, said that she<br />

will cont<strong>in</strong>ue to support ANA “from the sidel<strong>in</strong>es,”<br />

and called nurses “the most <strong>in</strong>telligent and<br />

dedicated <strong>in</strong>dividuals who are strong and smart<br />

and brave and bold.”

90 day period by 30 days, courts have consistently<br />

ruled that the 90 day deadl<strong>in</strong>e is not enforceable<br />

aga<strong>in</strong>st the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g. It<br />

has been my experience that an <strong>in</strong>vestigation can<br />

rema<strong>in</strong> open for as long as two years. Regardless<br />

<strong>of</strong> how long the <strong>in</strong>vestigation takes, the Bureau <strong>of</strong><br />

Pr<strong>of</strong>essional Licens<strong>in</strong>g will eventually take one or<br />

more <strong>of</strong> the follow<strong>in</strong>g actions:<br />

• Issuance <strong>of</strong> a formal adm<strong>in</strong>istrative compla<strong>in</strong>t<br />

aga<strong>in</strong>st the health care pr<strong>of</strong>essional;<br />

• Conduct a compliance conference, which<br />

allows the health care pr<strong>of</strong>essional to show<br />

his/her compliance with the public health<br />

code;<br />

• Summarily suspend the health care<br />

pr<strong>of</strong>essional’s license if the Bureau <strong>of</strong><br />

Pr<strong>of</strong>essional Licens<strong>in</strong>g has determ<strong>in</strong>ed the<br />

public’s health, safety, or welfare requires<br />

emergency action. Before a summary<br />

suspension is issued aga<strong>in</strong>st a health care<br />

pr<strong>of</strong>essional, the Bureau <strong>of</strong> Pr<strong>of</strong>essional<br />

Licens<strong>in</strong>g is required to consult with the chair<br />

<strong>of</strong> the respective pr<strong>of</strong>essional board;<br />

• Issue a cease and desist order, giv<strong>in</strong>g notice<br />

to the health care pr<strong>of</strong>essional that a<br />

particular conduct should cease; or<br />

• Dismiss the allegations be<strong>in</strong>g <strong>in</strong>vestigated,<br />

<strong>in</strong> which case the health care pr<strong>of</strong>essional<br />

will be advised by the Bureau <strong>of</strong> Pr<strong>of</strong>essional<br />

Licens<strong>in</strong>g that it has not found a violation <strong>of</strong><br />

the public health code and such matter will<br />

be closed. If the allegations are dismissed,<br />

all the <strong>in</strong>formation collected through<br />

documents, <strong>in</strong>terviews and other means will<br />

rema<strong>in</strong> <strong>in</strong> a closed, confidential file with the<br />

Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g.<br />

In the fourth and f<strong>in</strong>al article <strong>in</strong> this series, I will<br />

discuss the impact on the health care pr<strong>of</strong>essional<br />

when the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g issues<br />

an adm<strong>in</strong>istrative compla<strong>in</strong>t, as well as the health<br />

care pr<strong>of</strong>essional’s rights <strong>in</strong> defend<strong>in</strong>g aga<strong>in</strong>st an<br />

adm<strong>in</strong>istrative compla<strong>in</strong>t. <strong>The</strong> last article will also<br />

discuss the public report<strong>in</strong>g <strong>of</strong> any sanctions taken<br />

aga<strong>in</strong>st a health care pr<strong>of</strong>essional.<br />

Donna J. Craig, RN, JD is legal counsel to<br />

the ANA-<strong>Michigan</strong> Chapter. She practiced as a<br />

cardiac care nurse for several years before a<br />

chance opportunity to audit a graduate course<br />

<strong>in</strong> health care law and ethics which changed her<br />

career path. That course propelled her to earn<br />

her law degree. After law school Ms. Craig jo<strong>in</strong>ed<br />

a medical malpractice defense law firm before<br />

transition<strong>in</strong>g her focus to health care corporate<br />

and adm<strong>in</strong>istrative law matters. For over 20 years<br />
