the chance to withdraw from a
regional only last year, NJEA
reports. The 1976 law requires
the withdrawing community to
establish grounds for the
dtaolution, to make a fair
property settlement, and to
provide for the educational
custody of the children.
Regionalization • which lets
small communities band
together to provide larger,
more comprehensive schools
than -any of the constituent-
distiicts could provide alone •
was firs* p permitted by y a 1935
Stt State law. l New N JJersey
y now has
ISregkmab b running i programs
from kindergarten through 12th
grade. Another 47 run only high
schools, and two operate just
elementary grades. The 1976
law permits withdrawal only in
regtonals not operating a K-12
program.
In secondary regionals, each
member community also has a
local board of education
responsible for its own
elementary school system.
The opening move is to
request a report on the "advisability"
of the withdrawal
from '.the County Super in- -
tendent of Schools, NJEA says.
After this report is delivered,
the local community has 30
days to petition the State
Education Commissioner for
permission to put the question
to a vote.
The Commissioner, the State
Treasurer, and the top localgovernment
official from the
Department of Community
Affairs compose a "board of
review" that (l) decides
whether to permit the election
and (2) divides assets and
liabilities among the withdrawing
and remaining
communities.
Should the board of review
agree, a special election is.
scheduled no later than
December 1 in all the regional's.
member communities. If the
question gets a majority in the
total vote and in the withdrawing
community, 0 the
divorce, becomes effective the
