With greatest concerns I address our Palmas del Mar Homeowners Association,
involving safety concerns related to operational guidelines expected
from Golf Cart users, specifically referencing a signed Agreement
((PHA/Golf Cart Owner)) that outlines their usage at PHA common areas
and paths.
As witnessed with enclosed video, gross negligent operations of golf
carts at Palmas del Mar constitutes an inherit danger to occupants, causing
injuries beyond first aid, and many times broken limbs and head traumas.
Last weekend (26/27MAR22) our security staff, and local emergency
response units, were called to manage two (2) different golf cart injuries
involving minors, and adults., as operators. Both cases resulted in Golf
Carts overturned sideways at uncontrollable speeds. A total of seven (7)
passengers suffered injuries, described by attending paramedics as broken
limbs, head traumas and minor injuries.
Our community can’t remain silent, nor without action, while these injuries
are taking place. A collective and appropriate response is needed.
I will not impose bias stricter guidelines, nor will our PHA security staff
arbitrarily be able to prevent unsafe operation of Golf Carts. Our collective
goal shall center in preserving the integrity of our kids, families and visitors
that enjoy Palmas del Mar. Golf carts, when employed correctly, in a
safe manner, and with appropriate precautionary measures, constitute an
amenable family event at Palmas del Mar.
As a result, PHA Staff will spearhead a special committee, involving
key members of our community, insurance agents, security staff and TPA
representatives. The committee’s principal tasking will be to evaluate
Golf Cart accident data, in order to allocate and/or modify Golf Cart usage
guidelines, with recommended actions to be implemented.
Regardless of future actions, as I move forward with engaging a more
aggressive method geared towards preventing golf cart accidents, I must
recommend to each family that owns, operates and/or rents golf carts, to
conduct a “SELF-OPERATIONAL SAFETY CHECK.” Recommended “safety
check” shall include full familiarization with Golf Cart Operational functionalities,
limited operability, driving parameters, speeds, weather conditions,
etc., as an immediate means to avoid potential injuries. Golf Cart
engine/speed modifications are prohibited.
These matters will remain pending as our community awaits the recommendation
of designated committee. Any potential changes to our
current Golf Cart Use Agreement will be notified to our community. Comments
pertaining this communication can be forwarded to “palmaspha@
gmail.com”.
