Community Access to Information<br />

By-Laws<br />

Council undertook two processes to refresh and update its By-Laws during <strong>2022</strong>/<strong>2023</strong>.<br />

Firstly, Council’s By-Law 6 (Cats) was adopted and gazetted on 25 August <strong>2022</strong>. The State Government’s Legislative Review<br />

Committee then scrutinised the By-Law during early <strong>2023</strong>, and the By-Law was implemented on 1 June <strong>2023</strong>.<br />

Whilst the remainder of Council’s By-Laws (1-5), which came into effect on 1 January 2017, continued throughout the year,<br />

Council commenced a process to refresh By-Laws as follows prior to their expiration on 31 December <strong>2023</strong>:<br />

» By-Law 1 Permits and Penalties<br />

» By-Law 2 Moveable Signs<br />

» By-Law 3 Roads<br />

» By-Law 4 Local Government Land<br />

» By-Law 5 Dogs.<br />

Council made new By-Laws on 20 June <strong>2023</strong> and gazetted them on 13 July <strong>2023</strong>. The updated By-Laws commenced on<br />

13 November <strong>2023</strong>.<br />

Copies of all By-Laws and associated resolutions are accessible from Council’s website or Council’s office during business hours.<br />

Freedom of Information<br />

Council received 16 requests for access to information under the Freedom of Information Act from 1 July <strong>2022</strong> to 30 June <strong>2023</strong><br />

(compared to 6 in 2021/<strong>2022</strong>).<br />

» Two applications were transferred to EHA, one in full and one in part.<br />

» Two accredited Freedom of Information Officers spent approximately 8% of their time assessing<br />

applications and making their determinations.<br />

Council publishes an updated Freedom of Information Statement on its website<br />

annually in accordance with Section 9(1a) of the Freedom of Information Act 1991.<br />
