In addition to the ongoing process of harmonisation with/transposition of EU legislation, we advocate a solution<br />

that may involve a transitional phase-out of sanitary border control. A set of interlinked activities and measures<br />

to ensure that products placed on the market comply with all the requirements of health and safety protection<br />

will prioritise and push forward the principles of market surveillance;<br />

We suggest defining a set of technical requirements, stipulated by the Serbian legislation, for which control<br />

would not be implemented as it is now;<br />

In preparation for the prospective establishment of a market surveillance system, reshuffling the inspection towards<br />

the market is necessary;<br />

As imported goods are registered pursuant to the Law on Biocides or the Law on Chemicals, the Authorities are<br />

officially informed by the producer of their chemical composition. Therefore, it is unnecessary to perform laboratory<br />

analyses of each shipment upon import;<br />

In this light, we also propose the drafting and enactment of the Law on Market Surveillance and the Law on Inspection<br />

Surveillance, although inspection control is already part of the Law on Trade.<br />

CHEMICALS AND BIOCIDES<br />

cUrrEnt SitUation<br />

In the previous year, the Serbian Parliament passed amendments<br />

to the following laws of interest for the chemical and<br />

homecare products industry:<br />

Law on Chemicals, Law on Biocides, Law on Strategic Environmental<br />

Impact Assessment and Law on Waste Management.<br />

On the other hand, the Chemicals Agency adopted many<br />

by-laws, among them:<br />

By-laws pursuant to the Law on Chemicals: Rulebook on<br />

the Content of the Security List, List of Classified Substances,<br />

Rulebook on Restrictions and Prohibitions of<br />

Production, Marketing and Use of Chemicals that Pose an<br />

Unacceptable Risk to Human Health and the Environment,<br />

Rulebook on the Import and Export of Certain Hazardous<br />

Chemicals, Rulebook on Permits for Carrying Out Activities<br />

and Permits for the Use of Hazardous Chemicals, Guidebook<br />

Setting Preventive Measures for Safe Keeping, Storage<br />

or Use of Dangerous Chemicals, Rulebook Amending<br />

the Rulebook on the Classification, Packaging, Labelling<br />

and Advertising of Certain Chemicals and Products in<br />

Line with Globally Harmonised Classification and Marking,<br />

Rulebook on Keeping Records on Chemicals, Rulebook on<br />

Detailed Conditions for Keeping Hazardous Chemicals in<br />

the Sales Area and the Manner of Marking That Space;<br />

By-laws pursuant to the Law on Bioicides: Guidelines for<br />

the Assessment of Biocides on the Basis of the Technical<br />

Dossier, Rulebook on Keeping Records of Biocides, Rulebook<br />

on Certain Hazardous Biocides that May Not Be<br />

Marketed for General Use.<br />

With the adoption of the new laws and by-laws in the previous<br />

year, further improvement was achieved with regard to<br />
