The last year has brought numerous important changes<br />
in the functioning of the telecommunications regulatory<br />
framework.<br />
As a part of the reconstruction of the Government of the Republic<br />
of Serbia, a new Government was formed with 17 ministries<br />
in total. The Ministry of Telecommunications and Information<br />
Society and the Ministry of Culture were merged into<br />
the new Ministry of Culture, Media and Information Society.<br />
Immediately after the formation of the new Ministry, the<br />
Digital Agenda Administration was formed within the Ministry<br />
with the aim of finalising projects in the area of information<br />
and electronics and improving information and<br />
communication technologies in Serbia.<br />

It is necessary to have a regulatory body capable of implementing the<br />
new Law on Electronic Communications and undertake proper market<br />
analyses determined by the Law.<br />

Also, in March 2011, with great delay, the Serbian Government<br />
proposed candidates for members of the RATEL Managing<br />
Board, subsequently elected by the Parliament of the<br />
Republic of Serbia.<br />
With the purpose of enforcing the Electronic Communications<br />
Law, RATEL initiated public consultations on the enactment<br />
of the necessary by-laws. For the first time, nine markets<br />
subject to regulation were defined and the electronic<br />
communications market was analysed accordingly. Operators<br />
with significant market power (SMP operators) were proposed,<br />
as well as their obligations on the above grounds.<br />
The long-awaited sale of Telekom Srbija was not successful.<br />
In October 2010 tenders were invited for the sale of 51% of<br />
shares and, although the Government extended the deadline<br />
for the submission of bids, the sale of this state giant<br />
21
