On the other side, there is a set of laws that cover broader<br />

areas, but also include cosmetic products. These are:<br />

Law on Trade;<br />

Law on General Product Safety;<br />

Law on Consumer Protection.<br />

These laws are within the purview of the Ministry of Agriculture,<br />

Trade, Forestry and Water Management.<br />

As a result of all abovementioned regulations, imported cosmetic<br />

products are subject to control by the Sanitary Inspectorate<br />

of the Ministry of Health during import (before placing the<br />

product on the market), and all cosmetic products are subject<br />

to in-market control by both the Sanitary Inspectorate (Ministry<br />

of Health) and the Market Inspection (Ministry of Trade).<br />

PoSitiVE dEVELoPmEntS<br />

A new Draft Law on the Safety of Products for General Use<br />

has been prepared and, according to the Serbian European<br />

Integration Office Action Plan, should be adopted by the<br />

Government by the end of this year. After the passage of<br />

the law, it is expected that the whole range of by-laws will<br />

be adopted.<br />

Draft amendments to the Rulebook on the Conditions Regarding<br />

Health Safety of Food and Products for General<br />

Use that May be Placed on the Market was also prepared.<br />

The amendments were made to articles referring to cosmetic<br />

products. At that time, the majority of the text was<br />

harmonised with the Council Directive relating to Cosmetic<br />

products (76/768/EEC). This presents a good basis<br />

for the preparation of a by-law on cosmetic products,<br />

which should be completely harmonised with the current<br />

EU legislation.<br />

rEmaininG iSSUES<br />

The process of changing the regulations relating to cosmetic<br />

products has to be finished. Besides that, having in<br />

mind that EU legislation in this field is constantly being<br />

amended, the future by-law has to be flexible enough to<br />

follow the EU legislation and be amended accordingly.<br />

It is very important to avoid overlapping of regulations that refer to cosmetic products. This means that, once the<br />

by-law specifically regulating cosmetic products is adopted, all other, more general laws have to leave enough<br />

space and not impose additional restrictions. A good example where overlapping has been avoided successfully<br />

is the Law on General Product Safety, which states: “This Law applies to all products which are considered products<br />

under this Law, except for products for which specific regulations define their safety”;<br />

As for the type of control, it is our recommendation that competent authorities should focus more on in-market<br />

control, which is a practice in European countries. Import control should be mainly focused on product information<br />

file (product dossier), and, only where necessary, laboratory checks of the product.<br />

cUrrEnt SitUation<br />

Operating in a sustainable and socially responsible manner<br />

is becoming more and more important in view of the challenges<br />

facing society today, such as climate change or lim-<br />

ited availability of raw materials. On the one hand, products<br />

and processes have to be considered in terms of achieving<br />

a balance between economic, ecological and social goals.<br />

On the other hand, it is just as important to review the entire<br />

value chain, that is, the entire life cycle of a product.<br />

In the past, the Serbian Government has adopted many<br />
