Resumen 1 Ambiente Jurídico FAcultAd de derecho - universidAd de mAnizAles El derecho ha gozado de la metáfora Arquitectura jurídica en el plano doctrinal y en el práctico. Ella es también la propuesta de un correcto aprovechamiento del espacio hoy que se habla de la importancia del espacio público y del espacio global. Una cosa es cierta, la necesidad de habitar el espacio jurídico, de poblarlo y adecuarlo a las necesidades del terreno y del usuario. Una acertada Arquitectura jurídica que no sólo da cuenta del factor material, sino también del conjunto de necesidades que el ‘lugar’ le proporciona en unión al destinatario y la hace construir un adecuado espacio habitable. En este artículo, a través de un análisis crítico al cientificismo jurídico que quiere medir el derecho, se pretende hacer un esfuerzo por entender los usos y distinciones entre ‘orden’ y ‘sistema’, y si es posible, dotarlos de ‘sentido’; para determinar que el derecho moderno, en su afán obsesivo por elaborar estructuras seguras y rígidas, y por lo mismo poco flexibles, no soportan los movimientos telúricos de los cambios sociales. Abstract Law has conceived the metaphor of juridical architecture on the doctrinal and practical levels. This is also a proposal of a correct improving of space, today, when we talk about the importance of the public and global space. One thing is certain, the necessity of inhabiting and fitting the juridical space according to the user’s needs. A fitted juridical architecture that not only is concerned to the material aspects, but which also sets the necessities that the place offers to be a suitable and inhabitant one. In this article, through a critical analysis to the juridical science, it is attempted to do an effort to understand the uses and distinctions between “order” and “system “and to give these concepts meaning. This is done, to demonstrate that modern law does not endure the earthy movements of social changes.
