:Migue{}fnge[Pernánáez C¡onzáfez}f6ogaáoA partir <strong>de</strong> los preceptos constitucionales y legales, en consecuencia, estimamosque la conducta <strong>de</strong> los concejales I\licanor Herrera Quiroga, Marco Antonio Espinoza Cartagena,Verónica Elisa Aliaga Ramírez, Susana Hernán<strong>de</strong>z Collao y José Luis Alegría Tobarcontraviene el principio <strong>de</strong> probidad, pues están incumpliendo las obligaciones que la CartaFundamental y el or<strong>de</strong>namiento jurídico les impone como servidores <strong>de</strong> órganos públicos,sin que existan justificación en el interés general para ello y provocando una situación,<strong>de</strong> hecho, extraordinariamente compleja y perjudicial para la Municipalidad <strong>de</strong> LaFlorida¡ para su Concejo y, al fin y al cabo, para la comunidad local.Esa situación <strong>de</strong> hecho, a mayor abundamiento, como ya <strong>de</strong>cíamos, lesiona gravementela continuidad <strong>de</strong>l funcionamiento municipal, pues, más allá <strong>de</strong> la formalidad <strong>de</strong>hallarse un subrogante <strong>de</strong>sempeñando la función <strong>de</strong> alcal<strong>de</strong>, la naturaleza <strong>de</strong> ese cargoque requiere legitimidad <strong>de</strong>mocrática- torna indispensable que lo sirva el integrante <strong>de</strong>lConcejo que este órgano o, en subsidio <strong>de</strong> acuerdo al artículo 62, el concejal más votadoen la última elección.Ciertamente¡ el subrogante adoptará medidas y tomará algunas <strong>de</strong>cisiones <strong>de</strong> meraadministración o cuestiones mínimas e indispensables, pero no llegará a <strong>de</strong>cidir lascuestiones cruciales que, día a día, <strong>de</strong>ben ser resueltas o propuestas por el Alcal<strong>de</strong> elegido<strong>de</strong>mocráticamente, afectando la continuidad <strong>de</strong> la Ilustre Municipalidad <strong>de</strong> La Florida, ensu <strong>de</strong>ber constitucional <strong>de</strong> satisfacer las necesida<strong>de</strong>s <strong>de</strong> la comunidad local y asegurar suparticipación en el progreso económico, social y cultural <strong>de</strong> la comuna.Manifestación patente <strong>de</strong> lo antes expuesto, y expresión indubitada <strong>de</strong>l genuinoespíritu <strong>de</strong> la ley, es que el subrogante sólo pue<strong>de</strong> participar <strong>de</strong> los Concejos con su vozpero no con su voto¡ en consecuencia, se encuentra impedido <strong>de</strong> dirimir los empates quese pudieran presentar, y que la ley se preocupa expresamente <strong>de</strong> evitar. Siendo a<strong>de</strong>más<strong>de</strong> la mayor gravedad que, por la vía <strong>de</strong> los hechos, se este alterando in<strong>de</strong>bidamente elquórum <strong>de</strong> funcionamiento <strong>de</strong> el máximo órgano municipal.
:Migue{Jl11fJeCPernánáez qonzáfézJl6ogaáoTodo ello sin siquiera mencionar que, con su conducta, los concejales impi<strong>de</strong>n laejecución <strong>de</strong> las normas jurídicas vigentes y <strong>de</strong>jan sin efecto lo <strong>de</strong>cidido por los ciudadanosen la última elección municipal.Cuanto exponemos ha sido ya resuelto por esta Contraloría, en el Dictamen N°27.320, <strong>de</strong> fecha 9 <strong>de</strong> mayo <strong>de</strong> 2009, a raíz <strong>de</strong> una situación prácticamente idéntica acaecidaen la Municipalidad <strong>de</strong> Pelluhue.En ese pronunciamiento se dictaminó que "(...) los municipios <strong>de</strong>ben velar por lapermanente y continua atención <strong>de</strong> las necesida<strong>de</strong>s <strong>de</strong> la comunidad y que, por en<strong>de</strong>,tanto los funcionarios municipales como los concejales que obstaculicen la gestión municipalmediante acciones tendientes a entrabar la marcha normal <strong>de</strong> la entidad edilicia, incumplenel principio <strong>de</strong> continuidad <strong>de</strong>l servicio público".Esa obstaculización "(... ) vulnera el principio <strong>de</strong> probidad administrativa, aplicabletanto a funcionarios municipales como a concejales, y que implica observar una conductaintachable y un <strong>de</strong>sempeño honesto y leal <strong>de</strong> la función o cargo, con preeminencia <strong>de</strong>linterés general sobre el particular, el que, conforme al artículo 53 <strong>de</strong> la ley N° 18.575,Orgánica Constitucional <strong>de</strong> Bases Generales <strong>de</strong> la Administración <strong>de</strong>l Estado, se expresa,entre otros, en el recto y correcto ejercicio <strong>de</strong>l po<strong>de</strong>r público por parte <strong>de</strong> las autorida<strong>de</strong>sadministrativas, en lo razonable e imparcial <strong>de</strong> sus <strong>de</strong>cisiones y en la expedición en elcumplimiento <strong>de</strong> sus funciones legales".Por eso, el Dictamen referido señaló que los concejales "(... ) han sido electos por lacomunidad para representar sus intereses, siendo la asistencia a las sesiones <strong>de</strong>l órganocolegiado que integran, una <strong>de</strong> las obligaciones inherentes a sus cargos y, por otra, que laletra f) <strong>de</strong>l artículo 76 <strong>de</strong> la citada Ley N° 18.695 prevé como causal <strong>de</strong> cese <strong>de</strong>l ejercicio<strong>de</strong>l cargo <strong>de</strong> concejal, el incurrir en contravención grave al principio <strong>de</strong> probidad administrativa,la que, a requerimiento <strong>de</strong> cualquier concejal <strong>de</strong> la respectiva municipalidad, correspon<strong>de</strong><strong>de</strong>clarar al <strong>Tribunal</strong> Electoral Regional competente".POR TANTO
