SALINANDugaan pelanggaran atas Pasal 19 huruf d dan Pasal 22 Undang-undangNomor 5 Tahun 1999 tersebut terkait dengan tindakan TELKOM yang telahmemfasilitasi Huawei-Sansaine Consortium untuk menjadi pemenang tenderdalam hal pemenuhan kriteria peserta tender dan persyaratan teknis. Atas dasarhal tersebut maka Tim Pemeriksa akan melakukan analisa terhadap fakta-faktayang terkait dengan kapasitas Huawei-Sansaine Consortium dan persyaratanteknis sebagai berikut: ----------------------------------------------------------------------10.10 Kapasitas Huawei Sansaine Consortium -------------------------------------------------Dalam menilai apakah Huawei Sansaine Consortium merupakan pihak yangmemenuhi kriteria sebagai peserta tender MKCS maka dapat dilihat daribeberapa ketentuan yang mengatur mengenai kriteria peserta tender tersebut,yaitu: -------------------------------------------------------------------------------------------- The bidder(s) must be submarine cable owner or submarine line terminalequipment owner or submarine cable system constructor, which arealready pass the Palapa Ring prequalification bidding process- In Case the bidder(s) do not have its own complete system solution andcomply the technical requirement stated in Section III, the bidder shallprovide the sub-system solution with the following criteria: The un-repeater submarine cable shall pass the technical requirement atPalapa Ring prequalification bidding process which are Alcatel, Nexan,NSW, OCC, and Tyco Cable; The WDM terrestrial equipment shall have OTN and ROADMcapability; The SLTE shall have proven in 390 km distance of un-repeatersubmarine system.- The bidder shall have experience as the un-repeater submarinetransmission system provider as a main contractor and or subcontractor atleast at 2 (two) telecommunication companies/ operators out of origincountry- If the bidder can not intend to act as a sole supplier referring clause 2.2,the bidder shall establish a consortium or choose sub-contractor(s),subject to the following requirement: The consortium leader or main contractor shall be submarine cableowner or submarine line terminal equipment owner or submarine cablesystem constructor;14
