<strong>เม</strong>ื่อพิจารณาจากรัฐธรรมนูญฉบับที่ผ่านมา ไม่ปรากฏการ<br />
กาหนดหน้าที่รัฐในการพิทักษ์รักษาบูรณภาพแห่งเขต<br />
ที่ประเทศไทยมีสิทธิอธิปไตยแต่เพิ่งเริ่มปรากฏชัดในรัฐธรรมนูญ<br />
แห่งราชอาณาจักรไทย พุทธศักราช ๒๕๖๐ เป็นฉบับแรก ทั้งนี้<br />
เนื่องจากรัฐบาลไทย (โดยกระทรวงการต่างประเทศ) ได้ยื่น<br />
สัตยาบันสารสาหรับการเข้าเป็นภาคีอนุสัญญาสหประชาชาติฯ<br />
ต่อสหประชาชาติ <strong>เม</strong>ื่อวันที่ ๑๕ พฤษภาคม ๒๕๕๔ จึงส่งผลให้<br />
อนุสัญญาดังกล่าวมีผลใช้บังคับกับประเทศไทย ตั้งแต่วันที่ ๑๔<br />
มิถุนายน ๒๕๕๔ เป็นต้นมา และประเทศไทยจะต้องดาเนินการ<br />

baseline inclusive of the contiguous zone and the<br />
continental shelf (as illustrated in the diagram), Thailand<br />
has sovereign rights over the territory and seafloor of<br />
over 323,488.32 square kilometres in addition to the<br />
existing land area of at least 513,120 square kilometres.<br />
In other words, the sea areas owned by Thailand are<br />
approximately two-third of its land territory.<br />
When considering all of the previous constitutions,<br />
the role of state in protecting and upholding the<br />
integrity of the territories and the areas under Thailand’s<br />
sovereign rights is stated explicitly for the first time in<br />
the Constitution of the Kingdom of Thailand, B.E. 2560<br />
(2017). This is due to the Royal Thai Government (by<br />
the Ministry of Foreign Affairs) depositing the UNCLOS<br />
instrument of ratification at the United Nations on 15<br />
May 2011 and the coming into force of that convention<br />
for Thailand on 14 June 2011. The implementation of<br />
the UNCLOS has resulted in the enactment of new<br />
domestic laws and the amendment of the existing<br />
ones in order to make them conform to the convention.<br />
The adoption of the present Constitution with the<br />
provision on the integrity of the areas under Thailand’s<br />
sovereign rights is part of this implementation. Henceforth,<br />
amendments to relevant legislations and procedures<br />
will have to be made, and law enforcement activities<br />
will have to be carried out with a view to achieve the<br />
greatest benefits for the nation and protect our<br />
national interests in the areas subject to our sovereign<br />
rights.<br />
Furthermore, non-traditional threats that Thailand<br />
is now encountering have changed from their original<br />
forms. Exploitation of natural resources and energy,<br />
disasters and calamities as well as cyber threats have<br />
become more severe and threaten our national interests,<br />
economy, society and security in various dimensions.<br />
National dignity and peace among the Thai people will<br />
inevitably be affected in a negative way. Such problems<br />
may spread to large areas under the Thai sovereign<br />
