บางฉบับขึ้นใหม่ และแก้ไขปรับปรุงกฎหมายที่มีการใช้อยู่ใน<br />
ปัจจุบันให้สอดคล้องกับอนุสัญญาสหประชาชาติดังกล่าว<br />
โดยเฉพาะอย่างยิ่ง ในขณะนี้รัฐบาลได้เสนอร่าง พระราชบัญญัติ<br />
การรักษาผลประโยชน์ของชาติทางทะเล พ.ศ. .... แล้ว ซึ่งอยู่ใน<br />
ขั้นตอนการดาเนินการด้านนิติบัญญัติ ซึ่งหากมีผลใช้บังคับ<br />
ก็เท่ากับว่าเป็นกฎหมายแม่บทของการปฏิบัติการทางทะเล<br />
ที่สาคัญอีกหนึ่งฉบับของประเทศ ดังที่ได้กล่าวมาแล้วถึง<br />
ความสาคัญและเรื่องราวภารกิจต่างๆ ที่เกิดขึ้นในเขตสิทธิ<br />
อธิปไตยของประเทศไทย จึงนับว่าเป็นเรื่องสาคัญต่อบริบท<br />
ทางทหารในรูปแบบใหม่ของประเทศที่กระทรวงกลาโหมจะต้อง<br />
ดาเนินการให้เป็นไปตามเจตนารมณ์ของรัฐธรรมนูญแห่ง<br />
ราชอาณาจักรไทย พุทธศักราช ๒๕๖๐ และต้องถือปฏิบัติต่อไป<br />
โดยไม่มีข้อจากัดในเรื่องขอบเขตของเวลา กอปรกับเป็นการ<br />
เริ่มต้นก้าวย่างใหม่ของกระทรวงกลาโหมในทศวรรษที่ ๑๔ ที่<br />
จะต้องดาเนินไปบนพื้นฐานของความเป็นเอกราช อธิปไตย<br />
มีบูรณภาพแห่งเขตแดนอย่างมีเกียรติภูมิเป็นผลประโยชน์<br />
ของชาติที่มีความมั่นคงและตั้งอยู่บนแนวคิดการรักษาความสงบ<br />
เรียบร้อยของประชาชน จึงเป็นกาลที่อุดมไปด้วยความเหมาะสม<br />
ที่กระทรวงกลาโหมในยุคใหม่จะต้องเพิ่มบริบททางการทหาร<br />
เพื่อปฏิบัติการในเขตสิทธิอธิปไตยให้บังเกิดความสมบูรณ์<br />
พรั่งพร้อมไปด้วยความมั่นคงตลอดไป<br />
UNCLOS are absolutely necessary. The Royal Thai<br />
Government has presented the Bill on the Protection<br />
of National Interest in Maritime Areas, which is<br />
currently in the legislative process. Once this Bill<br />
becomes law, it will constitute one of the important<br />
parent laws governing maritime activities.<br />
In conclusion, Thailand’s accession to the UNCLOS<br />
and its important implications on domestic law and<br />
the government’s operation in areas subject to the<br />
sovereign rights of Thailand, as elaborated above, have<br />
given rise to the new context, in which our armed<br />
forces have to operate. The Ministry of Defence must<br />
continuously ensure that the military is well resourced<br />
and trained to address new challenges, so as to fulfill<br />
the intent of the Constitution of the Kingdom of<br />
Thailand, B.E. 2560 (2017). In doing so, the Ministry of<br />
Defence would be taking its first stride in its new<br />
decade. This important step forward must be guided<br />
by our relentless mission to protect our independence,<br />
sovereignty, territorial integrity, national interests, our<br />
great honour and to ensure that our citizens can live<br />
together in peace. This is the most appropriate<br />
moment for the Ministry of Defence to take on the<br />
new security context, its related challenges and make<br />
preparations accordingly, so that the country can<br />
protect its interests in areas under its sovereign rights<br />
to the fullest capacity.<br />
