EUROPEAN UNION’S INFLUENCE ON THE DISCIPLINE OF COMPETITION<br />

This article analyzes the transition of Albania in relation to the<br />

European Economic Constitution from the view point of free<br />

market and competition regulations. By analyzing the evolution<br />

of competition as a discipline in Albania, I aim at emphasizing<br />

the influence exerted by the European Union legislation in the<br />

field of free and fair com p etition w ith the p ersp ective of<br />

integrating the <strong>Albanian</strong> market into the European one. This<br />

p ersp ective brings to the fore the necessity of a norm ative<br />

harmonization in order to insure equal, safe, rational, efficient<br />

ru les that are vital to th e entrep reneu r system as w ell as<br />

functional to the economic growth and development. The article<br />

takes in and analyzes the reasons that led to the establishment<br />

of the first competition law, market conditions, the drawbacks<br />

and weaknesses of this law, the Stabilization and Association<br />

Process - Albania is currently a potential cand id ate country<br />

after the signing of the Stabilization and Association Agreement<br />

with the European Communities - as well as the changes in the<br />

field of competition that have come as a consequence of the<br />

new law on competition, which, as a matter of fact, is nearly<br />

approximated to the European legislation only in the formal<br />

w ay because it continues to contain m any am biguities. The<br />

article concludes with an evaluation of the similarities of the<br />

anti-trust laws in different Balkan countries, Albania included,<br />

which result to be in accordance to a common European model,<br />

constituted of Articles, 81 and on, to the Treaty on European<br />

Union as well as the norms deriving from them.<br />
