This article analyzes the transition of Albania in relation to the
European Economic Constitution from the view point of free
market and competition regulations. By analyzing the evolution
of competition as a discipline in Albania, I aim at emphasizing
the influence exerted by the European Union legislation in the
field of free and fair com p etition w ith the p ersp ective of
integrating the Albanian market into the European one. This
p ersp ective brings to the fore the necessity of a norm ative
harmonization in order to insure equal, safe, rational, efficient
ru les that are vital to th e entrep reneu r system as w ell as
functional to the economic growth and development. The article
takes in and analyzes the reasons that led to the establishment
of the first competition law, market conditions, the drawbacks
and weaknesses of this law, the Stabilization and Association
Process - Albania is currently a potential cand id ate country
after the signing of the Stabilization and Association Agreement
with the European Communities - as well as the changes in the
field of competition that have come as a consequence of the
new law on competition, which, as a matter of fact, is nearly
approximated to the European legislation only in the formal
w ay because it continues to contain m any am biguities. The
article concludes with an evaluation of the similarities of the
anti-trust laws in different Balkan countries, Albania included,
which result to be in accordance to a common European model,
constituted of Articles, 81 and on, to the Treaty on European
Union as well as the norms deriving from them.
janë huazuesit e normave, “norm - taker”. Në këtë sens shiko A. Björkdahl “Norm - maker and Norm - taker: Exploring the Normative Influence
of the EU in Macedonia”, in Eur.For, Aff, Review, 2005, faqe 259. “The adoption of EU norms by the candidate countries can be considered as a
process of socialization into the norm community of the EU. It has meant an intentional copying of the norms guiding the interaction of the EU member
states and attempts to match them with local pre-existing normative structure”.
