THURSDAY 27 AUGUST: THE INCIDENT AFTER VISITS; THE DECISION TO<br />

SEARCH SONNY LODGE’S CELL<br />

Summary<br />

9.1 In <strong>the</strong> morning <strong>of</strong> Thursday 27 August, Sonny Lodge attended a discharge board.<br />

Officer Downs was <strong>the</strong> escorting <strong>of</strong>ficer and made an entry in his history sheets that he<br />

would not be released. As a result <strong>of</strong> an altercation with Officer Downs on <strong>the</strong> way back<br />

from a visit in <strong>the</strong> afternoon, Mr Lodge was to be locked in his cell during <strong>the</strong> association<br />

period. Officers decided to search his cell. Mr Lodge complied with <strong>the</strong> strip search. His<br />

cellmate was elsewhere on <strong>the</strong> wing at <strong>the</strong> start <strong>of</strong> <strong>the</strong> search and was not searched. No<br />

unauthorised articles were found.<br />

The discharge board<br />

9.2 Sonny Lodge was due to complete <strong>the</strong> custodial part <strong>of</strong> his sentence on 31<br />

August and because <strong>of</strong> <strong>the</strong> Bank Holiday weekend he would have been released on<br />

Friday 28 August. He attended a ‘discharge board’ on Thursday morning. This was a<br />

meeting with a principal <strong>of</strong>ficer to deal with various administrative procedures. Because<br />

Sonny Lodge had been remanded in custody on <strong>the</strong> charge <strong>of</strong> assaulting Officer<br />

Brownley, he would not be released, though his status would change from sentenced to<br />

remand prisoner. Officer Downs escorted Mr Lodge and some o<strong>the</strong>r prisoners to <strong>the</strong><br />

discharge meeting and waited outside <strong>the</strong> <strong>of</strong>fice where <strong>the</strong> meeting was held. Officer<br />

Downs could not recall how many prisoners were in <strong>the</strong> group. When he came back to<br />

<strong>the</strong> wing he made an entry in Sonny Lodge’s history sheet that he had attended a<br />

discharge board but was ”NFR”, meaning not for release.<br />

9.3 Officer Downs told <strong>the</strong> inquiry that he did not know Sonny Lodge or why he would<br />

not be released. He had just returned to work after 11 days’ leave and Mr Lodge made<br />

no particular impression on him.<br />

The incident on <strong>the</strong> way back from visits<br />

9.4 In <strong>the</strong> afternoon <strong>of</strong> Thursday 27 August, Mr Lodge’s girlfriend visited him with her<br />

young niece and a friend. She told <strong>the</strong> Coroner’s <strong>of</strong>ficer <strong>the</strong> visit ended normally. As Mr<br />

Lodge was returning to G wing after <strong>the</strong> visit, <strong>the</strong>re was an altercation with Officer<br />

Downs.<br />
