Mr Bowcock said nei<strong>the</strong>r he nor Mr Downs had landed any blows on Mr Lodge.<br />

Mr Downs’ evidence<br />

10.17 In his written statement for <strong>the</strong> adjudication, Officer Downs said that <strong>the</strong> incident<br />

occurred as a result <strong>of</strong> Mr Lodge complaining that <strong>the</strong> cell was in a mess. When he was<br />

told that he needed to have a re-read <strong>of</strong> <strong>the</strong> wing rules he became agitated and lunged<br />

at Officer Bowcock. After a struggle in <strong>the</strong> cell Mr Lodge was restrained.<br />

10.18 According to <strong>the</strong> governor’s note <strong>of</strong> <strong>the</strong> adjudication, Officer Downs said Mr<br />

Lodge was agitated when he came back to <strong>the</strong> cell. He walked <strong>into</strong> <strong>the</strong> cell and shook<br />

his head. Officer Bowcock pointed out his attitude and referred him to <strong>the</strong> rules. Officer<br />

Downs was standing at <strong>the</strong> door ready to go. At this point Mr Lodge made a grab for<br />

Officer Bowcock. The governor asked whe<strong>the</strong>r Mr Lodge raised his hand. Officer Downs<br />

replied, “They were towards <strong>the</strong> <strong>of</strong>ficer.” The governor asked whe<strong>the</strong>r Mr Lodge moved<br />

towards Officer Bowcock. Officer Downs confirmed that he did. The governor asked<br />

whe<strong>the</strong>r Officer Downs interpreted <strong>the</strong> move as threatening. Officer Downs said that he<br />

asked Officer Cowley to press <strong>the</strong> alarm bell and went to Officer Bowcock’s assistance.<br />

10.19 In his statement to <strong>the</strong> police, Officer Downs said that on his return to <strong>the</strong> cell Mr<br />

Lodge appeared agitated and was shaking his head and “tutting”. He entered <strong>the</strong> cell<br />

and stood in <strong>the</strong> middle with Officer Bowcock by <strong>the</strong> cell window at <strong>the</strong> back and Officer<br />

Downs towards <strong>the</strong> cell door. Officer Bowcock explained that nothing was found but that<br />

Mr Lodge’s attitude needed addressing and that if he acted like an adult he would be<br />

treated like an adult on <strong>the</strong> wing. He referred Mr Lodge to <strong>the</strong> rules. Officer Downs said<br />

he did not recall whe<strong>the</strong>r <strong>the</strong>y were circled in red. Officer Downs said that while he was<br />

taking <strong>the</strong> main lock <strong>of</strong>f <strong>the</strong> door, Mr Lodge lunged towards Officer Bowcock with his<br />

arms raised. Officer Downs was unsure how Officer Bowcock fended him <strong>of</strong>f. Officer<br />

Downs took Mr Lodge’s left arm as his right was underneath him towards Officer<br />

Bowcock. They placed Mr Lodge face down on <strong>the</strong> floor.<br />

10.20 In oral evidence to <strong>the</strong> inquiry, Mr Downs said he recalled that he was standing at<br />

<strong>the</strong> cell door. The search had been concluded. He had put his key <strong>into</strong> <strong>the</strong> lock and was<br />

taking <strong>the</strong> lock <strong>of</strong>f when he heard a shout and saw Mr Bowcock and Mr Lodge going<br />

forward <strong>into</strong> <strong>the</strong> corner <strong>of</strong> <strong>the</strong> cell and <strong>the</strong>n <strong>the</strong>re was grappling and holding on. He saw<br />

contact between <strong>the</strong> two but did not see Mr Lodge hit Mr Bowcock.<br />
