NEW RULE I WELL STIMULATION ACTIVITIES COVERED BY DRILLING PERMIT<br />

(1) Except as provided in 36.22.609(2), well completion activities including hydraulic fracturing,<br />

acidizing, or other chemical stimulation performed to complete a well are permitted activities<br />

under the drilling permit for a well provided that a general description <strong>of</strong> anticipated hydraulic<br />

fracturing, acidizing or other chemical stimulation is included in the application for permit to<br />

drill.<br />

(2) For wildcat or exploratory wells or when the Operator is unable to determine that hydraulic<br />

fracturing, acidizing, or other chemical treatment will be performed to complete a well, the<br />

Operator must submit a written description <strong>of</strong> planned well completion activities to the <strong>Board</strong>'s<br />

staff prior to commencing such activities <strong>and</strong> the written description <strong>of</strong> planned fracturing,<br />

acidizing, or other planned chemical treatment must be submitted to the <strong>Board</strong>'s staff no less<br />

than 24 hours before commencement <strong>of</strong> well stimulation activities.<br />

(3) An Operator may comply with the disclosure requirements <strong>of</strong> this section 36.22.609 for<br />

hydraulic fracturing stimulation by submitting the well treatment description supplied to the<br />

Operator by the Service Company performing the hydraulic fracture stimulation including:<br />

(a) a copy <strong>of</strong> a final design <strong>of</strong> well treatment actually used for similar wells <strong>and</strong> which<br />

reflects the likely design for the well to be permitted; or<br />

(b) a pre-filed, generic design submitted for a specific geologic formation, specific<br />

producing field or specific geographic area.<br />

NEW RULE II DISCLOSURE OF WELL STIMULATION FLUIDS<br />

(1) Upon completion <strong>of</strong> well completion activities for a well, the Operator <strong>of</strong> a well shall provide<br />

the <strong>Board</strong>, on its Form No. 4 for a new well or Form No. 2 for an existing well:<br />

(a) a description <strong>of</strong> the interval(s) or formation treated;<br />

(b) the type <strong>of</strong> treatment pumped (acid, chemical, fracture stimulation); <strong>and</strong><br />

(c) the amount <strong>and</strong> type(s) <strong>of</strong> material pumped <strong>and</strong> the sustained pressure reached during<br />

treatment.<br />

(2) For hydraulic fracturing treatments the description <strong>of</strong> the amount <strong>and</strong> type <strong>of</strong> material used<br />

shall include:<br />

(a) a description <strong>of</strong> the stimulation fluid identified by additive type (e.g. acid, biocide,<br />

breaker, brine, corrosion inhibitor, crosslinker, demulsifier, friction reducer, gel, iron<br />

control, oxygen scavenger, pH adjusting agent, proppant, scale inhibitor, surfactant);<br />

(b) the chemical ingredient name <strong>and</strong> the Chemical Abstracts Service (CAS) Registry<br />

number, as published by the Chemical Abstracts Service, a division <strong>of</strong> the American<br />

Chemical Society (www.cas.org), for each ingredient <strong>of</strong> the additive used. The<br />

concentration for each additive shall be provided in appropriate measurement units<br />

(pounds per gallon, gallons per thous<strong>and</strong> gallons, percent by weight or percent by<br />

volume, or parts per million).
