Please add the comments below to the <strong>of</strong>ficial comments accepted regarding the ability <strong>of</strong> <strong>Montana</strong><br />

citizenry to access the verifiable truth as to the nature <strong>of</strong> the elements used in the fracking process<br />

proposed <strong>and</strong> implemented by mining <strong>and</strong> engineering companies operating within the state or affecting<br />

the natural resources <strong>of</strong> the state by proximate activities.<br />

<strong>Montana</strong> Citizens Rights to Healthy Clean Water <strong>and</strong> to control what is introduced to the environment <strong>of</strong><br />

the state <strong>of</strong> <strong>Montana</strong> is incontrovertable <strong>and</strong> must be protected.<br />

The chemical information for any fracturing fluids used needs to be easily accessible by the public on the<br />

<strong>Board</strong> <strong>of</strong> <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong>’ website. These chemicals need to be disclosed in advance in order for l<strong>and</strong>owners in<br />

areas such as Sweet Grass County to begin baseline water testing. All l<strong>and</strong>owners with water wells <strong>and</strong> springs<br />

within a 1 mile radius <strong>of</strong> the proposed well to be fracked, must receive written notification <strong>of</strong> the planned<br />

chemicals to be used . Companies should have to apply to the <strong>Board</strong> <strong>of</strong> <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong> <strong>and</strong> provide a written<br />

justification available to the public for any trade secret exemptions. Exemptions should only be granted in<br />

extremely rare circumstances. Even if the chemical is listed as a trade secret, it still must be disclosed to the<br />

<strong>Board</strong> <strong>of</strong> <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong> who must then accept responsibility for the decision to allow the use <strong>of</strong> this chemical <strong>and</strong><br />

any <strong>of</strong> its effects on individuals affected by that chemical's use.<br />
