Crim<strong>in</strong>alis<strong>in</strong>g youth<br />

The Crim<strong>in</strong>al Justice System that sets f<strong>in</strong>es for solicit<strong>in</strong>g has been ridiculed for <strong>in</strong>cre a s i n g<br />

the need for sex workers to solicit (Benson <strong>and</strong> Matthews, 1996; Edwards, 1997). This<br />

has been particularly criticised as a punitive response to young people <strong>in</strong>volved <strong>in</strong><br />

p rostitution (Lee <strong>and</strong> O’Brien, 1995). Several writers po<strong>in</strong>t out that vulnerable young<br />

people fear that the police will re t u rn them to accommodation where they have been<br />

ab<strong>use</strong>d (Adams et al., 1997) or which they f<strong>in</strong>d so abhorrent that they would rather<br />

p rostitute themselves <strong>and</strong> live on the streets (Lee <strong>and</strong> O’Brien, 1995). Lee <strong>and</strong> O’Brien<br />

po<strong>in</strong>t out that:<br />

if young people <strong>in</strong>volved <strong>in</strong> prostitution perceive themselves as offenders they may be<br />

less likely to identify themselves as victims even though they are <strong>in</strong> need of police<br />

protection or other professional assistance.<br />

It is to be expected that it will take time for the police to develop trust <strong>and</strong> a reputation for<br />

car<strong>in</strong>g with these young people who may have learned to distrust the police on the basis of<br />

earlier polic<strong>in</strong>g policy.<br />

‘Trapp<strong>in</strong>g’ <strong>and</strong> ‘exit<strong>in</strong>g’<br />

New guidance<br />

Safeguard<strong>in</strong>g Children Involved <strong>in</strong> Prostitution is the guidance issued by The Department of<br />

Health, The Home Office, The Department for Education <strong>and</strong> Employment <strong>and</strong> the National<br />

Assembly for Wales <strong>in</strong> 2000 as supplementary guidance to <strong>Work</strong><strong>in</strong>g Together to Safeguard<br />

Children (1999). It is guidance for an <strong>in</strong>ter-agency approach by:<br />

the police, health, social services, education <strong>and</strong> all other agencies <strong>and</strong><br />

professionals that may work with children about whom there are concerns that they<br />

are <strong>in</strong>volved <strong>in</strong> prostitution.<br />

It applies to young people of both sexes aged under 18. It is issued under section 7 of the<br />

Local Authority Social Services Act 1970 <strong>and</strong> as such it must be complied with unless there<br />

a re exceptional local circumstances which justify a variation. The ma<strong>in</strong> po<strong>in</strong>ts of the<br />
