Experts interviewed for this report do not expect<br />

this situati<strong>on</strong> to change in <strong>the</strong> near term; <strong>the</strong><br />

nati<strong>on</strong>al strategy says <strong>on</strong>ly that opti<strong>on</strong>s c<strong>on</strong>cerning<br />

<strong>the</strong> Vietnam Bank for Social Policy (VBSP) will be<br />

c<strong>on</strong>sidered up until 2020.<br />

l Although <strong>the</strong> plan for <strong>the</strong> development of <strong>the</strong><br />

microfi nance sector until 2020 issued by <strong>the</strong> prime<br />

minister (No.2185/QD-TTg <strong>on</strong> December 6th 2011)<br />

paves <strong>the</strong> way for <strong>the</strong> development of microfi nance<br />

in Vietnam, <strong>the</strong> Law <strong>on</strong> Credit Instituti<strong>on</strong>s has<br />

<strong>the</strong>oretically closed <strong>the</strong> door to <strong>the</strong> establishment<br />

of new MFIs. However, in reality, mass<br />

organisati<strong>on</strong>s at <strong>the</strong> local level are still setting up<br />

new revolving funds and applying to become social<br />

funds. So far, n<strong>on</strong>e have been barred from doing<br />

so. That said, <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s for establishment as<br />

prescribed in Decrees 28 and 165 require that <strong>the</strong><br />

main applicants be a political-social organisati<strong>on</strong><br />

or a social organisati<strong>on</strong> with <strong>the</strong> minimum<br />

operating experience of three years.<br />

l An improving regulatory framework has allowed<br />

two programmes to transform into licensed MFIs,<br />

but <strong>the</strong>se may be <strong>the</strong> excepti<strong>on</strong> ra<strong>the</strong>r than <strong>the</strong><br />

rule, in part because <strong>the</strong> regulatory requirements<br />

are excessively <strong>on</strong>erous relative to <strong>the</strong> capacity of<br />

<strong>the</strong> small, semi-formal programmes to meet <strong>the</strong>m<br />

and transform.<br />

l The 2010 Law <strong>on</strong> Credit Instituti<strong>on</strong>s requires<br />

regulated MFIs to publish rates and fees. Both<br />

regulated and n<strong>on</strong>-regulated MFIs and state-owned<br />

providers clearly state interest rates in leafl ets and<br />

advertisements before disbursing loans. There are<br />

still many small unregulated programmes,<br />

however, that are not subject to this law.<br />

l Few support structures exist for microfi nance<br />

operators, including technical advisory services,<br />

funding, quality and standards protocol, data<br />

ga<strong>the</strong>ring and c<strong>on</strong>solidati<strong>on</strong> (with comm<strong>on</strong><br />

defi niti<strong>on</strong>s), or auditors with specifi c MF<br />

experience.<br />

Key changes and impacts since last year:<br />

l In 2011, three microfi nance organisati<strong>on</strong>s<br />

within <strong>the</strong> M7 network toge<strong>the</strong>r received <strong>the</strong><br />

sec<strong>on</strong>d licence granted to microfi nance operators.<br />

At least <strong>on</strong>e more, <strong>the</strong> Fund for ThanhHoa Poor<br />

Women, is preparing to apply for a licence.<br />

l Multiple efforts by d<strong>on</strong>or agencies are <strong>on</strong>going<br />

to try to improve <strong>the</strong> regulatory framework and<br />

supervisory capacity of <strong>the</strong> State Bank of Vietnam<br />

(SBV, <strong>the</strong> central bank). A renewed effort to make<br />

d<strong>on</strong>or co-ordinati<strong>on</strong> happen is taking shape.<br />

l Dispute resoluti<strong>on</strong> mechanisms are informal.<br />

Disputes with <strong>the</strong> VBSP are resolved via people’s<br />

committees at <strong>the</strong> district and commune levels.<br />

According to sector experts, microfi nance customer<br />

complaints have been reduced as VBSP’s service<br />

levels have improved. In <strong>the</strong> past, <strong>the</strong>re had been<br />

more complaints. For unregulated MFIs, disputes<br />

are resolved via <strong>the</strong> people’s committees, although<br />

this is outside of any legal framework.
