9. Copies offonnally approved <strong>University</strong> procedures, rules and/or<br />
policies. These documents will be provided within ten (1 0) working days of receipt of a<br />
written request from the FF A.<br />
4 B. Member Responsibilities:<br />
5 Members are responsible for providing the Employer with the address and telephone<br />
6 number at which they are to be contacted. The Employer has no liability if written notices are<br />
7 sent to such addresses or calls are made to such telephone numbers.<br />
8 2.11 Non-Discrimination<br />
9 The Employer and the FF A both recognize their responsibilities under federal, state and<br />
10 local laws pertaining to fair employment practices as well as the moral principles involved in the<br />
1! area of civil rights. Accordingly, both parties reaffirm by this Agreement the commitment not to<br />
12 discriminate against any person or persons because of race, creed, color, religion, national origin,<br />
13 ancestry, age, gender, marital status, sexual preference, handicap, FFA or MEA-NEA affiliation.<br />
14 Any member claiming a violation of this Section must seek relief in the appropriate legal forum<br />
15 and may not use the grievance process unless the nature of the alleged discrimination is not a<br />
I 6 violation of the law.<br />
17 Section 3 - TENURE<br />
18 3.1 Definitions and General Conditions<br />
19 A. Tenure is the right to continual employment in a bargaining unit position<br />
20 until voluntary separation from FSU employment, lay-off or tennination for just cause under the<br />
21 contractual process in Section4.<br />
22 B. All employees of the <strong>University</strong> awarded tenure prior to the ratification of<br />
23 this Agreement shall retain such tenure.<br />
24 3.2 Employer Tenure Policy<br />
25 A. The tenure policy described in this Agreement applies only to non-tenured<br />
26 members. Tenure shall not be acquired automatically by length of service, but rather through the<br />
27 criteria and procedures set forth in this Agreement. There shall be no arbitrary establishment of<br />
28 a fixed proportion of tenured to non-tenured members by the FFA, the Employer or any<br />
29 division(s) thereof. Only continuous appointment as a member shall be counted toward<br />
30 qualification for tenure. However, except in the specific case ofFSU administrators, the<br />
31 following applies:<br />
32 1. One full year's absence, or less, from the bargaining unit but not the<br />
33 <strong>University</strong> shall not be considered an intenuption of continuous service with respect to<br />
34 qualification for tenure.<br />
35 2. All time in excess of one full year's absence from the bargaining unit<br />
36 but not the <strong>University</strong> shall, by rounding to the nearest academic semester,<br />
37 correspondingly reduce the time counted toward qualification for tenure previously<br />
38 accumulated in the bargaining unit.<br />
