I 3.6 Academic Administrator Appointment with Tenure<br />
2 A. Academic department heads, directors, deans, the provost/vice president for<br />
3 Academic Affairs and the president may be granted tenure subject to the following conditions:<br />
4 I. The academic department head, director, dean, provost/vice president<br />
5 for Academic Affairs and president must possess qualifications appropriate to the<br />
6 academic discipline in which tenure is conferred.<br />
7 2. The academic department head, director, dean, provost/vice president<br />
8 for Academic Affairs and president must have previously attained tenure at a regionally<br />
9 accredited post-secondary or first professional-degree-granting institution.<br />
I 0 3. The tenured faculty in the academic discipline in which the person is<br />
11 to be conferred tenure must be provided the opportunity to review and share comments<br />
12 with their department head, dean, and the provost/vice president for Academic Affairs or<br />
13 the president of FSU on the candidate's qualifications preceding tbe offer of tenure to the<br />
14 candidate.<br />
15 B. Academic administrators who are granted tenure according to Section 3.6.A<br />
16 will not accrue seniority during the course of their administrative appointment. If an academic<br />
17 administrator with tenure moves from his/her administrative position to a faculty position,<br />
18 he/she will commence accruing seniority in the bargaining unit and will thereafter be subject to<br />
19 all provisions of this Agreement, except those having to do with the attainment of tenure.<br />
20 Section 4- REPRESENTATION AND PROFESSIONAL CONDUCT<br />
21 4.1 Discipline<br />
22 A. The Employer and the FF A recognize a mutual responsibility for promoting<br />
23 professional conduct that encourages quality in the educational process, thereby reflecting<br />
24 favorably upon tbe <strong>University</strong>. Breaches of professional conduct, as differentiated from<br />
25 incompetence, are subject to discipline including, but are not limited to: abuse of sick leave and<br />
26 other leaves, excessive tardiness, willful deficiencies in professional conduct and/or<br />
27 performance, violation of Employer policies, regulations and administrative directions not<br />
28 inconsistent with the terms of this Agreement, and violation of tbe terms of this Agreement.<br />
29 Alleged breaches of professional conduct shall be reported promptly to the offending member.<br />
30 Issues pertaining to competence will be handled through evaluation.<br />
31 B. Disciplinary action shall be defined as any oral or written warning; oral or<br />
32 written reprimand; disciplinary probation; suspension, except for suspensions pending<br />
33 investigation; discharge for misconduct or any combination of the above, of which a formal<br />
34 record is kept or of which the disciplined member is thereafter formally prejudiced. In no case<br />
35 will a member be subjected to disciplinary action without just cause or on the basis of any<br />
36 anonymous information.<br />
3 7 C. A member shall be notified of the right to have FF A representation at any<br />
38 meeting at or from which disciplinary action, as defined in this Section, may result. In no event<br />
