1 8.8 Retraining Sabbatical<br />
2 A. A tenured member notified oflayoff or laid off is eligible for a retraining<br />
3 sabbatical. He/she may prepare a proposal which describes the intended education or work-<br />
4 related program and submit it to the provost/vice president for Academic Affairs. If the<br />
5 provost/vice president for Academic Affairs believes the proposal has merit, it shall be granted.<br />
6 B. Retraining sabbaticals shall be governed by Section 10.4 regarding duration<br />
7 and pay. However, they shall be granted only when connected with layoff and shall not be<br />
8 considered under Section 1 0.4.<br />
9 8.9 BuyOut<br />
I 0 A. A buy out must be offered to each member in the curriculun1 area,<br />
11 department or seniority group in which the reduction occurs. The provost/vice president for<br />
12 Academic Affairs may refuse any member the right to participate. Acceptance of a buy out<br />
13 constitutes termination of employment under the following conditions:<br />
14 1. The Employer will pay one (I) year's salary at his/her rate of pay at the<br />
15 time of termination. The member may elect to receive the pay in either (I) a lump sum,<br />
16 (2) in installments over the regular academic year, or (3) in installments over the regular<br />
17 fiscal year;<br />
18 2. Provided the insurance carrier agrees, the life insurance, health<br />
19 insurance and dental insurance in effect at the time of termination will be continued for<br />
20 one (I) calendar year with premiums fully paid by the Employer;<br />
21 3. Accumulated sick leave will be paid as though he/she had retired<br />
22 according to Section 10.l.E.3 of this Agreement; and<br />
23 4. The member forfeits and waives all rights to recall or other options<br />
24 pursuant to tllis Agreement.<br />
25 B. The buy out is effective June 1 or July 1 for 10 or 12 month members,<br />
26 respectively, following termination of employment.<br />
27 C. Having accepted a buy out, a member may elect to forfeit the last year of<br />
28 employment as described in Section 8.4.<br />
29 Section 9- GRIEVANCE PROCEDURE<br />
30 9.1 Definition - Grievance<br />
31 A. A grievance is an alleged violation of a specific section of this Agreement.<br />
32 B. A grievance may be initiated by one or more members and must be signed by<br />
33 all grievants, and the conclusion of the grievance shall be applicable to all grievants.<br />
34 C. An Association grievance may be initiated by the FF A when the FF A's<br />
35 specific rights, as distingnished from the rights of the individual members of the FF A, under<br />
37
