1 2. The provost/vice president for Academic Affairs may assign to a<br />
2 faculty position an administrator who was not previously in the bargaining unit. The<br />
3 decision of the provost/vice president for Academic Affairs may be appealed to the<br />
4 president ofFSU by a majority vote of the tenured members of that seniority group. The<br />
5 decision of the president is final, binding and not subject to arbitration.<br />
6 The provost/vice president for Academic Affairs may, after receiving the<br />
7 recommendation from the appropriate members, assign rank to an administrator.<br />
8 An administrator who has not previously been granted tenure at FSU but who<br />
9 transfers to a bargaining unit position shall be subject to the tenure review process in<br />
I 0 Section 3, except that the non-reappointment provisions of Section 3 shall become effective<br />
11 after the third year of the faculty appointment.<br />
12 3. The salary for an administrator assigned to a bargaining unit position<br />
13 will be determined by the provost/vice president for Academic Affairs, taking into<br />
14 consideration the existing salaries of members in the seniority group, the College and<br />
15 <strong>University</strong> Personnel Association (CUP A) salary survey for state colleges and universities,<br />
16 individual credentials, rank and degree.<br />
17 B. A member may seek to transfer from one seniority group to another without<br />
18 losing benefits under this Agreement, provided he/she meets all the qualifications for the<br />
19 position to which he/she is seeking to transfer. His/her credentials shall be reviewed pursuant to<br />
20 Section 7.6.<br />
21 Except as provided in Section 8. 7. C, tenure granted a member is retained regardless of<br />
22 position within or without the bargaining unit while an employee of the <strong>University</strong>. Tenure status<br />
23 of non-tenured members shall be in accordance with Section 3 of this Agreement.<br />
24 7.10 Academic Calendar<br />
25 The academic calendar will continue to be determined by the Employer in a manner<br />
26 consistent with current practice and the 1994 semester conversion previously approved by the<br />
27 Employer and the FF A. The Employer recognizes the FF A's reservation of right to bargain over<br />
28 issues related to the calendar in accordance with applicable law should it elect to do so in<br />
29 successor negotiations.<br />
30 Section 8- RETRENCHMENT<br />
31 8.1 Definition<br />
32 Retrenchment is defined as a reduction in the number of faculty in any curriculum area,<br />
33 department or seniority group.<br />
34 8.2 Retrenchment by Attrition and Voluntary Reassignment<br />
35 A. Retrenchment may be accomplished through attrition, including, but not<br />
36 limited to, resignation or retirement.<br />
