Federal Odometer Statement<br />

The federal law requires that the seller state the mileage on a title transfer and that the<br />

buyer acknowledge the mileage. To accomplish this, both the buyer and seller must sign<br />

and hand print, type or computer generate their names on the odometer statement.<br />

The same person cannot act on behalf of both the buyer and seller on a federal odometer<br />

statement, except in the case of a wholesale, dealer-to-dealer, transfer.<br />

A sale to a leasing company is not considered wholesale; it is considered a retail sale.<br />

The selling or acquiring dealer cannot sign for the purchaser or seller by power of<br />

attorney on the odometer statement.<br />

The federal odometer statement does not require notarization. For sample form, see<br />

exhibit "Q".<br />

Seller’s Affidavit<br />

A seller’s affidavit is appropriate in order to satisfy <strong>Ohio</strong>’s odometer requirements when<br />

a vehicle not covered by federal law is sold.<br />

The seller of the vehicle must sign the form and it must be notarized.<br />

Applicant’s Affidavit<br />

The applicant’s affidavit is to be used in very specific instances when a mileage<br />

declaration is required in order to obtain a title and the federal odometer statement would<br />

be inappropriate.<br />

The applicant’s affidavit is to be used on all repossession titles, self-assembled vehicles,<br />

unclaimed affidavits and when a vehicle is being converted from out-of-state.<br />

In the case of a sale from out-of-state, federal odometer laws still apply. For sample<br />

form, see exhibit "R".<br />
