of several key rights. To participate effectively, people need to be able to organise<br />

<strong>the</strong>mselves freely (freedom of association), to communicate <strong>the</strong>ir op<strong>in</strong>ions frankly<br />

(freedom of expression) and to <strong>in</strong>form <strong>the</strong>mselves (right to access to <strong>in</strong>formation).<br />

With respect to operationalis<strong>in</strong>g participation, it is sensible to th<strong>in</strong>k <strong>in</strong> terms<br />

of <strong>the</strong> breadth (who is <strong>in</strong>volved) and <strong>the</strong> depth of <strong>the</strong> process (<strong>the</strong> degree of<br />

<strong>in</strong>fluence). 10 In addition, a number of political risks (e.g., co-option, manipulation)<br />

need to be considered.<br />

International Covenant on Civil and Political <strong>Rights</strong> (ICCPR)<br />

Article 19<br />

1. Everyone shall have <strong>the</strong> right to hold op<strong>in</strong>ions without <strong>in</strong>terference.<br />

2. Everyone shall have <strong>the</strong> right to freedom of expression; this right shall <strong>in</strong>clude <strong>the</strong><br />

freedom to seek, receive and impart <strong>in</strong>formation and ideas of all k<strong>in</strong>ds, regardless of<br />

frontiers, ei<strong>the</strong>r orally, <strong>in</strong> writ<strong>in</strong>g or <strong>in</strong> pr<strong>in</strong>t, <strong>in</strong> <strong>the</strong> form of art or through any o<strong>the</strong>r media<br />

of his choice.<br />

Article 21<br />

<strong>The</strong> right of peaceful assembly shall be recognised. No restrictions may be placed on<br />

<strong>the</strong> exercise of this right o<strong>the</strong>r than those imposed <strong>in</strong> conformity with <strong>the</strong> law and which<br />

are necessary <strong>in</strong> a democratic society <strong>in</strong> <strong>the</strong> <strong>in</strong>terests of national security or public<br />

safety, public order, <strong>the</strong> protection of public health or morals or <strong>the</strong> protection of <strong>the</strong><br />

rights and freedoms of o<strong>the</strong>rs.<br />

Article 22 (paragraph 1)<br />

Everyone shall have <strong>the</strong> right to freedom of association with o<strong>the</strong>rs, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> right<br />

to form and jo<strong>in</strong> trade unions for <strong>the</strong> protection of his <strong>in</strong>terests.<br />

Article 25<br />

Every citizen shall have <strong>the</strong> right and <strong>the</strong> opportunity... without unreasonable<br />

restrictions:<br />

a) To take part <strong>in</strong> <strong>the</strong> conduct of public affairs, directly or through freely chosen<br />

representatives;<br />

b) To vote and to be elected at genu<strong>in</strong>e periodic elections which shall be by universal<br />

and equal suffrage and shall be held by secret ballot, guarantee<strong>in</strong>g <strong>the</strong> free expression<br />

of <strong>the</strong> will of <strong>the</strong> electors;<br />

c) To have access, on general terms of equality, to public service <strong>in</strong> his country.<br />
