Between 1946 and 2009, more than 80 national access to <strong>in</strong>formation laws<br />
(AILs) were enacted around <strong>the</strong> world. 22 From a human rights perspective and<br />
follow<strong>in</strong>g <strong>the</strong> Atlanta Declaration and Plan of Action for <strong>the</strong> Advancement of<br />
<strong>the</strong> Right of Access to Information, 23 <strong>the</strong> right of access to <strong>in</strong>formation should<br />
respect <strong>the</strong> follow<strong>in</strong>g key pr<strong>in</strong>ciples:<br />

Access to <strong>in</strong>formation is <strong>the</strong> rule; secrecy is <strong>the</strong> exception.<br />
<strong>The</strong> right of access to <strong>in</strong>formation should apply to all branches of government<br />
(<strong>in</strong>clud<strong>in</strong>g executive, judicial and legislative bodies, as well as autonomous<br />
organs), at all levels (federal, central, regional and local) and to all divisions<br />
of <strong>in</strong>ternational bodies.<br />
<strong>The</strong> right of access to <strong>in</strong>formation should extend to non-state actors that<br />
receive public funds or benefits (directly or <strong>in</strong>directly); carry out public<br />
functions, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> provision of public services; and exploit public<br />
resources, <strong>in</strong>clud<strong>in</strong>g natural resources.<br />
<strong>The</strong> right of access to <strong>in</strong>formation should <strong>in</strong>clude a right to request and<br />
receive <strong>in</strong>formation and a positive obligation on public <strong>in</strong>stitutions to<br />
dissem<strong>in</strong>ate <strong>in</strong>formation related to <strong>the</strong>ir core function.<br />
<strong>The</strong> right to request <strong>in</strong>formation is <strong>in</strong>dependent of a personal <strong>in</strong>terest <strong>in</strong> that<br />
<strong>in</strong>formation, and <strong>the</strong> provision of a justification or reason should never be<br />
required.<br />
<strong>The</strong> <strong>in</strong>strument or law should <strong>in</strong>clude procedures designed to ensure full<br />
implementation and ease of use, and an affirmative obligation to assist <strong>the</strong><br />
requester, provide requested <strong>in</strong>formation with<strong>in</strong> a specified and reasonable<br />
period of time, and impose no unnecessary obstacles (such as cost,<br />
language, form or manner of request).<br />
Exemptions to access to <strong>in</strong>formation should be narrowly drawn, specified<br />
<strong>in</strong> law and restricted to exemptions permitted by <strong>in</strong>ternational law. All<br />
exemptions should be subject to a public <strong>in</strong>terest override, which mandates<br />
release of o<strong>the</strong>rwise exempt documents when <strong>the</strong> public benefit of release<br />
outweighs <strong>the</strong> potential public harm.<br />
<strong>The</strong> burden of proof to justify a denial should always fall on <strong>the</strong> holder of<br />
<strong>in</strong>formation.<br />
<strong>The</strong> <strong>in</strong>strument should mandate full disclosure, after a reasonable period<br />
of time, of any document that was classified as secret or confidential for<br />
exceptional reasons at <strong>the</strong> time of its creation.<br />
<strong>The</strong> <strong>in</strong>strument should <strong>in</strong>clude clear penalties and sanctions for noncompliance<br />
by public officials.<br />
