Box 9. Collective Action for <strong>the</strong> Right to Hous<strong>in</strong>g<br />
Public hous<strong>in</strong>g programmes often generate corruption, when <strong>the</strong> number of households<br />
entitled to receive a subsidy exceeds <strong>the</strong> number of places <strong>in</strong> subsidised units, for<br />
example, or when public officials have discretion to determ<strong>in</strong>e who is eligible for<br />
support. Bribes may be paid to ga<strong>in</strong> access to hous<strong>in</strong>g by those who do not meet<br />
<strong>the</strong> hous<strong>in</strong>g policy requirements and those who do. In a context of fixed supply and<br />
lack of accountability, <strong>the</strong> most common practice is to operate two lists: one for honest<br />
applicants and ano<strong>the</strong>r faster queue for those who make payoffs.<br />
In Kenya, widespread land grabb<strong>in</strong>g and corruption among bureaucrats and politicians<br />
<strong>in</strong> charge of particular programmes have characterised public hous<strong>in</strong>g programmes<br />
s<strong>in</strong>ce <strong>the</strong> 1990s. Because procedures are opaque, fraud has been widespread. Public<br />
land already designated for o<strong>the</strong>r purposes was allocated; multiple allocations of <strong>the</strong><br />
same piece of land have been made. In this context, tenants associations formed<br />
<strong>the</strong> Shelter Committee of ILISHE Trust, which brought toge<strong>the</strong>r community based low<strong>in</strong>come<br />
groups to challenge and expose <strong>the</strong> illegal allocation of public land. (ILISHE is<br />
<strong>the</strong> Kiswahili equivalent of a Legal Awareness Programme.)<br />
Council tenants <strong>in</strong> Kenya have adopted several strategies to secure legal recognition<br />
of <strong>the</strong>ir right to adequate hous<strong>in</strong>g. <strong>The</strong>y have <strong>in</strong>volved victims of corruption <strong>in</strong> tenants<br />
campaigns, formed an umbrella organisation, used <strong>the</strong> media and public forums to<br />
ga<strong>in</strong> support, articulated criticisms and debated policy and taken direct action to<br />
block illegal construction.<br />
This case shows how disadvantaged social groups can challenge corruption through<br />
<strong>the</strong> media, by ga<strong>in</strong><strong>in</strong>g media attention and us<strong>in</strong>g formal and <strong>in</strong>formal strategies.<br />
<strong>The</strong> campaign also made use of <strong>in</strong>ternational human rights treaties <strong>in</strong> <strong>the</strong> absence<br />
of national legislation grant<strong>in</strong>g <strong>the</strong> right to adequate hous<strong>in</strong>g. Though <strong>the</strong> actions of<br />
<strong>the</strong> Shelter Committee have not yet changed <strong>the</strong> practices and procedures of <strong>the</strong><br />
government’s Hous<strong>in</strong>g Development Department, <strong>the</strong>y have helped reduce some of<br />
<strong>the</strong> worst damage caused by corruption.<br />
