Council Directive 96/82/EC of 9 December 1996 on the control of major-accident hazards involving<br />
dangerous substances, as amended by Directive 2003/105/EC<br />
Article 2: Scope<br />
The Directive shall apply to establishments where dangerous substances are present in quantities<br />
equal to or in excess of the quantities listed in Annex I, Parts 1 <strong>and</strong> 2, column 2, with the exception of<br />
Articles 9, 11 <strong>and</strong> 13 which shall apply to any establishment where dangerous substances are present<br />
in quantities equal to or in excess of the quantities listed in Annex I, Parts 1 <strong>and</strong> 2, column 3.<br />
The Directive sets out two levels of requirements corresponding to ‘lower tier’ <strong>and</strong> ‘upper tier’<br />
establishments.<br />
Article 7: Major-accident prevention policy<br />
Member States shall require the operator to draw up a document setting out his major-accident<br />
prevention policy <strong>and</strong> to ensure that it is properly implemented. The major-accident prevention policy<br />
established by the operator shall be designed to guarantee a high level of protection for man <strong>and</strong> the<br />
environment by appropriate means, structures <strong>and</strong> management systems.<br />
