Summary
The Graystar Addition is taking the steps necessary to begin constructing improvements for
development to occur. As the development of the Graystar First Addition begins, it has
become necessary to annex a portion of 37 th St. platted right of way that is currently outside
the City limits of Hays. In order for the developer to set up a benefit district and include the
improvements to 37 th St. within the district, it must first be annexed into the City. The Ellis
County Commission has given written consent to have the City go forward and annex the
right of way of 37 th St. City Staff recommends adopting the ordinance approving this
annexation.
Background
The Graystar Addition is taking the steps necessary to begin constructing improvements for
development to occur. An existing street (37 th St.) adjacent to the new addition will
potentially be used for access to the new development but must first be improved to City
standards.
Discussion
As the development of the Graystar First Addition begins, it has become necessary to annex a
portion of 37 th St. right of way platted in the Westridge Addition that is currently outside the
City limits of Hays. In order for the developer to set up a benefit district and include the
improvements to 37 th St. within the district, it must first be annexed into the City. Of the
approximately 1300 lineal feet of 37 th St., there are approximately 700 feet that lies in the
County and the remaining 600 feet are in the City. The current condition of 37 th St. is not
conducive to the extra traffic that will be generated along with the new development. City and
County Public Works staff have agreed that the improvements to 37 th St. are necessary to help
provide a secondary means of access to the development. Currently the west portion of 37 th
St. lies within the County and is County maintained. Once annexed and constructed to City
standards, which include curb and gutter, the entire portion of 37 th St. will be City maintained.
