Summary<br />
The Graystar Addition is taking the steps necessary to begin constructing improvements for<br />
development to occur. As the development <strong>of</strong> the Graystar First Addition begins, it has<br />
become necessary to annex a portion <strong>of</strong> 37 th St. platted right <strong>of</strong> way that is currently outside<br />
the <strong>City</strong> limits <strong>of</strong> <strong>Hays</strong>. In order for the developer to set up a benefit district and include the<br />
improvements to 37 th St. within the district, it must first be annexed into the <strong>City</strong>. The Ellis<br />
County Commission has given written consent to have the <strong>City</strong> go forward and annex the<br />
right <strong>of</strong> way <strong>of</strong> 37 th St. <strong>City</strong> Staff recommends adopting the ordinance approving this<br />
annexation.<br />
Background<br />
The Graystar Addition is taking the steps necessary to begin constructing improvements for<br />
development to occur. An existing street (37 th St.) adjacent to the new addition will<br />
potentially be used for access to the new development but must first be improved to <strong>City</strong><br />
standards.<br />
Discussion<br />
As the development <strong>of</strong> the Graystar First Addition begins, it has become necessary to annex a<br />
portion <strong>of</strong> 37 th St. right <strong>of</strong> way platted in the Westridge Addition that is currently outside the<br />
<strong>City</strong> limits <strong>of</strong> <strong>Hays</strong>. In order for the developer to set up a benefit district and include the<br />
improvements to 37 th St. within the district, it must first be annexed into the <strong>City</strong>. Of the<br />
approximately 1300 lineal feet <strong>of</strong> 37 th St., there are approximately 700 feet that lies in the<br />
County and the remaining 600 feet are in the <strong>City</strong>. The current condition <strong>of</strong> 37 th St. is not<br />
conducive to the extra traffic that will be generated along with the new development. <strong>City</strong> and<br />
County Public Works staff have agreed that the improvements to 37 th St. are necessary to help<br />
provide a secondary means <strong>of</strong> access to the development. Currently the west portion <strong>of</strong> 37 th<br />
St. lies within the County and is County maintained. Once annexed and constructed to <strong>City</strong><br />
standards, which include curb and gutter, the entire portion <strong>of</strong> 37 th St. will be <strong>City</strong> maintained.<br />
