Commission Work Session Agenda Memo From: Meeting: Subject: Person(s) Responsible: Jesse Rohr, PIE Superintendent November 4, 2010 Work Session Graystar First Addition Resolution to Establish Improvement District (37 th St.) Toby Dougherty, City Manager Brenda Herrman, Director of Public Works Summary Graystar Corporation has petitioned the City for street improvements to 37 th St. in relation to the Graystar First Addition project. 37 th St. will be constructed from just east of Post Rd. west to Hwy 183 Alternate. The engineers estimate for total construction costs are $580,594 including engineering costs. This project is consistent with past residential developments within the City of Hays. Staff recommends adopting the attached resolution authorizing the improvements in the estimated and amount of $580,594. Background The final plat for Graystar First Addition was approved at the April 22, 2010 City Commission meeting. The property is zoned R-1, single-family residential district. The developer wishes to establish a benefit district to fund the improvements for the residential development. The planned improvements to 37 th St. will allow for secondary access to the development. Discussion Graystar Corporation has petitioned the City for street improvements to 37 th St. in relation to the Graystar First Addition project. This will be constructed along with the first phase of the development. The Developer will pay 30% (estimated at $174,178)of the costs for the construction of 37 th St. from just east of Post Rd. west to Hwy 183 Alternate with the remaining 70% (estimated at $406,416) to be assessed to Lots 1-14 of the Graystar First Addition and two adjacent lots that lie on the north side of 37 th St. (It is important to note that the owners of the two adjacent lots north of 37 th St. within the improvement district are not willing signers to the petition. However State Statute allows for the proportionate costs of the improvements to be assessed to these properties which will benefit from the improvements.
