the purpose of intimidating the student attacked by threatening<br />

him with social or other ostracism or by submitting such student<br />

to ignominy, shame or disgrace among his fellow students and<br />

acts calculated to produce such results; or<br />

• The playing of abusive or truculent tricks on or off the school<br />

property of the <strong>McDonald</strong> <strong>County</strong> R-1 School District by one<br />

student alone or acting with others, upon another student to<br />

frighten or scare him; or<br />

• Any willful act on or off the property of the <strong>McDonald</strong> <strong>County</strong><br />

R-1 School District by one student alone or acting with others<br />

which is directed against any other student done for the purpose<br />

of humbling the ride, stifling the ambition or impairing the<br />

courage of the student attacked or to discourage him/her from<br />

remaining in the <strong>McDonald</strong> <strong>County</strong> R-1 School District rather<br />

than to submit to such acts; or<br />

• To any student of the <strong>McDonald</strong> <strong>County</strong> R-1 school District or<br />

any other educational institution; or assault upon any such<br />

student made for the purpose of committing any of the acts or<br />

producing any of the results to such students as defined by this<br />

paragraph.<br />

• Any act or activity which violates any law or policy of the<br />

<strong>McDonald</strong> <strong>County</strong> R-1 School district when such an act or<br />

activity is taken to further the interest of a gang, it shall be the<br />

duty of the school district to suspend or expel from the<br />

<strong>McDonald</strong> <strong>County</strong> R-1 School District any pupil who shall:<br />

• Be or remain a member, promise to join, become a member or<br />

solicit other persons to join, promise to join or pledge to become<br />

a member of any prohibited secret society or organization; or<br />

• Wear or display any insignia for purposes of identification with<br />

any such secret society or organization while in and attending<br />

<strong>McDonald</strong> <strong>County</strong> R-1 Schools, or any school related activity.<br />

NCLB COMPLAINT PROCEDURES<br />

Missouri Department of Elementary & Secondary Education<br />

The Federal No Child Left Behind Act of 2001 (NCLB), Title IX Part C. Sec.<br />

9304(a)(3)(C) requires the Missouri Department of Elementary & Secondary<br />

Education (DESE) to adopt procedures for resolving complaints regarding<br />

operations of programs authorized under the Act, including Title I, Title II,<br />

Title III, Title IV (Part A), Title V, Title VI, and Title VII and Title IX, part C.<br />

Who May File a Complaint<br />

Any local education agency (LEA), consortium of LEAs, organization, parent,<br />

teacher, or member of the public may file a complaint.<br />

Definition of a Complaint<br />

There are both formal and informal complaint procedures.<br />

A formal complaint must be a written, signed statement that includes:<br />

1. an allegation that a federal statute or regulation applicable to the state<br />

educational agency (SEA) or a<br />

local education agency (LEA) program has been violated,<br />

2. facts, including documentary evidence that supports the allegation, and<br />

3. the specific requirement, statute, or regulation being violated.<br />
