MOTION TO EXCEED PAGE LIMITATIONS<br />

The Appellant asks permission to file a brief that is 60 pages in length.<br />

1. Background. The appellant’s brief is due July 4, 2013.<br />

2. Authority. Supreme Court Rule 6.07(e).<br />

3. Reasons:<br />

a. The record on appeal in this case consists of 30 volumes and several thousand pages<br />

of exhibits;<br />

b. The trial lasted nearly a month and there were several other hearings on motions and<br />

other matters which are the subjects of this appeal;<br />

c. This case involves numerous complex and significant legal issues, including the<br />

constitutionality of K.S.A. 60-3701 et seq. and the interpretation of the wrongful death<br />

statute, K.S.A. 60-1901;<br />

d. Because of the complex facts and issues, it has been impossible for counsel to<br />

condense the brief to the 50-page limit and still address properly all the issues before this<br />

Court;<br />

e. Counsel was able to condense the brief to 60 pages, not counting the table of<br />

contents and appendices.<br />

Therefore, the Appellant asks the Court for permission to file a 60-page brief.<br />
