multe funcţii şi nu au funcţia de bază la
unitatea raportoare. Pentru a evita
dubla/multipla înregistrare se respectă
definiţia din Codul fiscal (cu modificările şi
completările ulterioare) referitoare la
activitatea dependentă la funcţia de bază,
respectiv „orice activitate desfăşurată în
baza unui contract individual de muncă
sau a unui statut special prevăzut de lege,
declarată angajatorului ca funcţie de bază
de către angajat; în cazul în care
activitatea se desfăşoară pentru mai mulţi
angajatori, angajatul este obligat să
declare fiecăruia locul unde exercită
funcţia pe care o consideră de bază”. Sunt
excluse cadrele militare şi personalul
asimilat (M.A.N., M.A.I., S.R.I. etc.).
Câştigul salarial nominal brut
cuprinde salariile, respectiv drepturile în
bani şi în natură cuvenite salariaţilor pentru
munca efectiv prestată (inclusiv pentru
timpul lucrat suplimentar) potrivit formei de
salarizare aplicată, sporurile şi
indemnizaţiile acordate ca procent din
salariu sau în sume fixe, alte adaosuri la
salarii potrivit legii, sumele plătite pentru
timpul nelucrat (indemnizaţiile pentru
concediile de odihnă şi studii, zile de
sărbătoare şi alte zile libere, sumele plătite
din fondul de salarii pentru concediile
medicale), premiile, primele de vacanţă şi
alte sume plătite din fondul de salarii
conform actelor normative sau contractelor
colective de muncă, sumele plătite din
profitul net şi alte fonduri (inclusiv
contravaloarea tichetelor de masă).
Câştigul salarial nominal net se
obţine prin scăderea din câştigul salarial
nominal brut a: impozitului, contribuţiei
salariaţilor pentru asigurările sociale de
sănătate, contribuţiei individuale de
asigurări sociale de stat şi a contribuţiei
salariaţilor la bugetul asigurărilor pentru
şomaj.
Câştigul salarial mediu lunar
reprezintă raportul dintre sumele plătite
salariaţilor de către agenţii economici în
luna de referinţă, indiferent pentru ce
perioadă se cuvin, şi numărul mediu de
salariaţi. Numărul mediu al salariaţilor
reprezintă o medie aritmetică simplă
calculată pe baza efectivelor zilnice ale
salariaţilor din luna respectivă. Salariaţii
care nu sunt angajaţi cu normă întreagă se

Avoiding the double/multiple registration
meets the definition of the Fiscal Code (as
amended and supplemented) regarding
the activity dependent on the basic
function, namely "any activity carried out
under an individual labour contract or a
special status provided by the law, stated
by to the employer as basic function of the
employee; if the work is performed for
several employers, each employee is
obliged to declare for each of them the
place where he considers to carry out the
basic function ". There are excluded
military staff and similar (Ministry of
National Defence, Ministry of
Administration and Interior, Romanian
Intelligence Service etc.).
The gross nominal earnings
comprises salaries, respectively money
rights and rights in kind of employees for
the effectively done work (including
overtime), according to the salary type
applied, benefits and indemnities granted
as salary percentage or in fixed amounts,
other legal rises of salary, amounts paid
for the non-worked time (indemnities for
rest and study leaves, holidays, other
days-off, amounts paid from salary fund for
medical leaves), prizes, holidays bonuses
and other amounts paid from salary fund
according to normative documents or
collective labour contracts, amounts paid
from the net profit and other funds
(including the equivalent value of lunch
tickets).
The net nominal earnings is
obtained subtracting from the gross
nominal earnings the following: the tax on
earnings, the contribution of employees to
the health social insurance, the individual
contribution to the state social insurance
and the employees’ contribution to
unemployment insurance budget.

The monthly average earnings
represents the ratio between the amounts
paid to the employees by economic
operators in the reference month, no
matter of the period and the average
number of employees. Average number of
employees' represents a simple arithmetic
mean calculated based on daily numbers
of employees in the respective month.
