ROADS PROVISIONS - GENERAL RG 1) no access roads will be permitted through municipal property or using existing municipal access roads. RG 2) in accordance with the municipal policy, municipal permission is required prior to any removal of any tree from the Municipal road allowance. Tree replacement will be accordance with the “Tree Retention and Replacement Policy”. RG 3) the developer and municipality will jointly determine the process for relocating the project’s infrastructure in the future if necessary. RG 4) if it is necessary for a road to be closed, the developer will follow the municipal road closing protocol. RG 5) the municipality shall have the authority to order the stoppage of work or cessation of activities on the highway where the conditions of the agreement have not been met. RG 6) in addition to the requirement to call for locates prior to undertaking work, the developer will be required to participate in the “Ontario One Call” program to reduce damages in the future to underground facilities and promote safe excavations. 107
NOISE COMPLAINT PROTOCOL One of the concerns raised by residents is the noise emanating from the turbine operations. There needs to be assurances from the Developer that a process is in place to expeditiously resolve residents concerns related to noise. In other areas, the developer provided “message centres” with an on call operator, and also, established a website where residents could report issues. The developer would be required to provide details on the process that would be followed when complaints are received and the intended process to resolve issues and would also be required to maintain a log of all calls received and include the manner in which the concern was addressed by the developer. COMPLAINT PROTOCOL Similar to the Noise Complaint Protocol, the developer would be required to provide information on the process to address other concerns residents may have, such as communication disruptions or issues pertaining to the construction or personnel. As with the Noise Complaint Protocol, the developer would be required to provide details on the process that would be followed when complaints are received and the intended process to resolve issues and would be required to maintain a log of all calls received and include information on how the concern was addressed by the developer. DECOMMISSIONING OF TURBINES The assurance that the decommissioning of the turbines takes place at the end of the project life is a Provincial responsibility, and the “Decommissioning Plan” is part of the report that the companies are required to provide for the Provincial “REA” application submission. The stated purpose of the plan is to provide information on the “closure plan” for the project and how the developer proposes to remove the facility components and restore the project location to an acceptable condition for its intended use. Details on the plans for dealing with the electrical infrastructure, substation and switching stations and access roads are also provided to the Province, as is a site restoration plan. Some municipalities are not satisfied with leaving the assurances for the decommissioning with the Province and are asking for security in the form of a bond or letter of credit to guarantee the turbines and appurtenances are properly removed at the end of the project. The legalities of this are still being investigated, and further information will be provided in future reports. DRAINS Municipal drains are constructed to improve the drainage of agricultural land and serve as the discharge point for private agricultural tile drainage systems. Drains are a vital component of the rural infrastructure, and can be manmade ditches, closed tile systems 108
