• January 6, 2004 – Nobile wrote <strong>to</strong> George <strong>to</strong> complain that Capra had<br />

observed him on that day even though George had agreed that Capra<br />

would no longer conduct the classroom observations <strong>of</strong> Nobile.<br />

• January 8, 200[4] – in an e-mail exchange between Nobile and Cohen,<br />

Nobile stated he just wanted Capra <strong>of</strong>f his back and her actions would<br />

“boomerang.” 189<br />

• January 8, 200[4] – in a correspondence from Nobile <strong>to</strong> George, Nobile<br />

complained about receiving a “U” rating. 190<br />

• January 9, 2004 – Capra documented her January 6, 2004, observation <strong>of</strong><br />

Nobile.<br />

• January 20, 2004 – in a <strong>letter</strong> <strong>to</strong> “the Capra Delegation,” Nobile wrote that<br />

Capra had no plans for dropping Regents scores at the school. 191 Nobile<br />

asked that George not permit Capra <strong>to</strong> observe him alone.<br />

• January 26, 200[4] – in a <strong>letter</strong> <strong>to</strong> George, Nobile suggested a procedure<br />

whereby he, as the UFT Chapter Leader, would be in charge <strong>of</strong> overseeing<br />

the Regents scoring. 192 He claimed that members <strong>of</strong> the Social Studies<br />

Department had expressed concerns <strong>to</strong> him about the marking <strong>of</strong> Regents<br />

exams in the recent past.<br />

• February 10, 2004 – Nobile received a “U” rating from Capra. She<br />

prepared a <strong>letter</strong> documenting her reasons. 193<br />

• February 20, 2004 – Nobile wrote <strong>to</strong> George <strong>to</strong> grieve Capra’s January 9,<br />

2004, <strong>letter</strong> <strong>to</strong> his file, which was based on her “unauthorized observation”<br />

<strong>of</strong> his class on January 6, 2004.<br />
