“unleashed Ms. Capra” on him. In a second <strong>letter</strong>, Nobile accused Capra<br />
<strong>of</strong> retaliating against him and George <strong>of</strong> cooperating with her. 209 In the<br />
third document, an amended version <strong>of</strong> the second, Nobile elaborated<br />
upon his accusations against Capra. 210<br />
• May 8, 2004 – Nobile wrote an e-mail <strong>to</strong> the NYSED stating: “Principal<br />
and AP Capra know that they are guilty.”<br />
• May 10, 2004 – in a <strong>letter</strong> <strong>to</strong> George, Nobile stated he was amending his<br />
May 6 th <strong>letter</strong> <strong>of</strong> grievance pertaining <strong>to</strong> Capra’s April 15, 2004,<br />
observation and advised George “[i]f you do not immediately remove Ms.<br />
Capra as my supervisor, you are collaborating in her corrupt retaliation.”<br />
• May 11, 2004 – Jill Bloomberg, Regional Instructional <strong>Special</strong>ist for<br />
Region 8, reviewed Nobile and, in a document dated May 17, 2004, she<br />
gave him a “U” rating.<br />
• May 11, 2004 – in a <strong>letter</strong> <strong>to</strong> Capra, Nobile referred <strong>to</strong> Capra’s May 6 th<br />
<strong>letter</strong> regarding informal visit <strong>to</strong> his classroom the previous day. 211 He<br />
concluded this <strong>letter</strong> with: “Finally, your effort <strong>to</strong> U me out <strong>of</strong> the school<br />
system will boomerang. Count on it.” 212<br />
• May 13, 2004 – the UFT requested an investigation claiming that Nobile<br />
had been subjected <strong>to</strong> harassment by Capra and that George and Lyles had<br />
not taken adequate steps <strong>to</strong> resolve the situation.<br />
• May 13, 2004 – Nobile wrote <strong>to</strong> the NYSED claiming that “[George]<br />
orchestrated a coverup as Ms. Capra orchestrated the crime.” Nobile<br />
stated he would be going <strong>to</strong> talk <strong>to</strong> Scarcella about George.<br />

during 6 th period on March 10, 2003. Instead you jumped the gun and observed me 4 th period when you<br />
knew I was unprepared…. Fourth, you are an unfair and poisonous manager.... As Mr. Vince Leardi,<br />
one <strong>of</strong> your favorite teachers, emailed the Principal on April 7, 2004: ‘It also seems like the his<strong>to</strong>ry dept.<br />
bears all the burden <strong>of</strong> U observations and that many <strong>of</strong> them are for personal reasons.’… Fifth, you are<br />
unfit <strong>to</strong> be an Assistant Principal.” The emphasis was in Nobile’s correspondence.<br />
