• May 13, 2004 – Capra was removed from her position at <strong>Cobble</strong> <strong>Hill</strong> and<br />

reassigned <strong>to</strong> the Region.<br />

• May 17, 2004 – in a communication <strong>to</strong> Hyland, Nobile provided questions<br />

that he stated George should be asked. In addition, Nobile claimed that<br />

George intended <strong>to</strong> “destroy [his] career.”<br />

• May 18, 2004 – Europe sent an e-mail message <strong>to</strong> Lyles and Pelles which<br />

indicated that it appeared that Nobile would receive a “U” and be<br />

discontinued. 213 Europe also stated that Nobile was claiming that the<br />

administration was now retaliating for him being a “whistle blower.”<br />

Europe requested that the matter be looked in<strong>to</strong> <strong>to</strong> ensure that there was no<br />

retaliation.<br />

• May 18, 2004 – Nobile wrote <strong>to</strong> George regarding George’s April 16,<br />

2004, observation <strong>of</strong> Nobile. 214 Nobile said that he welcomed “the<br />

Principal’s unsatisfac<strong>to</strong>ry rating because it reveals his naked retaliation<br />

against a whistleblower.”<br />

• May 18, 2004 – Mei wrote <strong>to</strong> Pelles and Lyles advising them that she had<br />

arranged <strong>to</strong> have the US His<strong>to</strong>ry and Global Regents exams scored. 215<br />

• May 18, 2004 – in a string <strong>of</strong> e-mails which followed Mei’s May 18,<br />

2004, message, Europe wrote <strong>to</strong> Pelles, Mei, and Lyles and asked: “Are<br />

you looking in<strong>to</strong> whether Mr. George intends on firing Nobile. Timing<br />

would really be bad for us as it would look like a straight case <strong>of</strong><br />

retaliation. Please let me know.” 216<br />

• May 25, 2004 – George signed an Annual Pr<strong>of</strong>essional Performance<br />

Review and Report on Probationary Service <strong>of</strong> Pedagogical Employee<br />

form which indicated that the principal had given Nobile a “U” rating for<br />

the 2003-2004 school year. 217<br />

certification <strong>of</strong> completion <strong>of</strong> probation for Nobile, also was dated May 25, 2004.
